An appellate court in California has held that bumblebees are fish:
The issue presented here is whether the bumble bee, a terrestrial invertebrate, falls within the definition of fish, as that term is used in the definitions of endangered species in section 2062, threatened species in section 2067, and candidate species (i.e., species being considered for listing as endangered or threatened species) in section 2068 of the Act.
It takes 35 pages of tortured logic in an opinion that reads like a parody, but the court concludes that bumblebees indeed are fish within the meaning of California’s environmental laws.

Geez...amending a legislated LAW is done by the Legislatures, and if they have declined to do so? That is that until the next try. If the plaintiffs did not attempt that route, then the court should have immediately sent them there.
Even the SEC overreach via regulatory interpretation beyond the Law was recently smacked down.
This is ludicrous.

Well, that's no surprise! If they can't tell a Man from a Woman, why would we expect them to tell a Bumble Bee from a Fish! I can't wait to see how they explain Fish can Fly and Bees can Swim!

I just explained to my dog, Ginger I said, if you move to Kalifornia you can be a pelican. With a puzzled look on her face I went on, if you are a pelican you can eat fish. I did warn her, however, if you try to eat fish you have to be careful of the small ones with wings. Those are the ones that can fly and sting you so be very selective of the fish you choose. Ginger just looked at me like I was nuts and went back to sleep.

I would like to note that while this is ridiculous, the law itself includes a definition of "fish", which can be read to include bees. In fact, the definition seems to definitively include bees as fish, although the examples given in the law clearly indicate that those who wrote the law only intended to include aquatic invertebrates (they did not however actually write that the definition of "fish" so as to do so).

This is just one of the many strange things going on in California. I used to travel there on business trips and the climate was ideal, the people, not so much. In their defense, I've actually seen bees swim. They buzz around in a little circle on the surface of the water until a fish notices and eats them. Does that make the fish a cannibal?

I have a four year old grand niece who would answer the "Is a bumblebee a fish?" question with, "No, don't be silly, it a BUG not a fish. Fish swim in the water!"
But, federal judges aren't as smart as a four year old little girl these days.

While we're feasting on snark with this, it might be worth remembering that the "science" proves that Bumblebee physiology is not capable of generating sufficient lift for flight.
