Karl Denninger nails this issue today. The question arises—suppose the SCOTUS were to reverse the Fifth Circuit’s stay on the Zhou regime’s experimental injection mandate? Would the Firth Circuit feel obliged to rule in favor of the mandate? I suspect not. The tone of the Fifth Circuit’s opinion upholding the stay was extremely hostile to the mandate, which they clearly viewed as having no reasonable basis—aside from the issue of whether OSHA even has the authority to enforce such a mandate.(snip) the data that he cites—powerful as it is—is only scratching the surface of what scientific groups will be able to bring forward against the mandate.

The holiday season has long been a source of contention for many families, but this year families may be even more divided with almost two-thirds of fully jabbed Americans reportedly planning to ban their unvaccinated relatives from holiday festivities. The November 2 study by OnePoll analyzed the responses of 2,000 U.S. residents about how the COVID-19 vaccine has influenced relationships with loved ones. Fully vaccinated individuals accounted for 65 percent of respondents and nearly six out of 10 of those respondents had already severed ties with unvaccinated family members. CORRECTION*

The 2018 midterm elections sent a shiver through national Republicans not only because several prominent House Republicans lost their seats. It was also where they lost them that concerned GOP party leaders. The Democrats gained 41 seats in the House in 2018. But Republicans consoled themselves by picking up two additional Senate seats. The problem for the GOP was not that they couldn’t win statewide elections. The problem was that they were losing control of one of their primary strongholds: big-city suburbs and exurbs. That spelled trouble for holding on to their House majority. Specific demographic groups had abandoned Republicans in droves, including suburban moms and single women.

The judge at Kyle Rittenhouse’s murder trial has dismissed a count of possession of a dangerous weapon by a person under 18. The charge is only a misdemeanor, but it had appeared to be among the likeliest to net a conviction for prosecutors. There’s no dispute that Rittenhouse was 17 when he carried an AR-style semi-automatic rifle on the streets of Kenosha in August 2020 and used it to kill two men and wound a third. But the defense argued that Wisconsin’s statute had an exception that could be read to clear Rittenhouse. That exception involves whether or not a rifle or shotgun is short-barreled.  CORRECTIONS*

The Biden administration will inevitably ask the Supreme Court to review last Friday’s decision by the 5th Circuit Court of Appeals to halt its vaccine mandate. The effort is likely to be futile, however. Writing for the appeals court, Judge Kurt Engelhardt confidently predicted that the mandate’s challengers “are likely to succeed on the merits” under judicial review. Engelhardt took particular exception to the attempt to impose the mandate through the Occupational Safety and Health Administration (OSHA), pointing out that the Constitution’s Commerce Clause and the nondelegation doctrine preclude OSHA from making such “sweeping pronouncements on matters of public health affecting every member of society in the profoundest of ways.”
