Rogue Judges Are Turning Judicial Review
Into Judicial Rule

Original Article

President Donald Trump made headlines this week by continuing deportation flights of illegal immigrants, including members of the violent Tren de Aragua gang, despite a federal judge’s ruling that attempted to halt the practice. [Snip] For too long, judges have operated under the assumption that their authority is limitless, that elected officials must bow to their rulings no matter how far they stray from the Constitution. [Snip] Even the Supreme Court has recognized the dangers of this judicial overreach. In Trump v. Hawaii (2018), Chief Justice John Roberts warned lower courts that they do not have the authority to micromanage national security decisions made by the executive.

Comments:

The author asserts “the real authoritarianism creeping into the United States, not from the executive branch, but from a judiciary that no longer respects its own limits. To safeguard our democracy, each branch of government must function within its own jurisdiction,... It’s fitting that when a judge oversteps his bounds as Boasberg did this week, the executive would provide a necessary check.” ~ “It is not what a lawyer tells me I may do, but what humanity, reason, and justice tell me I ought to do.” (Edmund Burke)

"The Constitution does not give judges an enforcement mechanism for their rulings." This means that the Judicial and Executive branch must operate in sync to enforce the law. To do this, the Executive must have strong confidence in the legitimacy of the courts decisions. In many cases, there is not a clash between the powers of the Executive vs. those of the Judiciary so there is no conflict. But what we have here is Leftists in the court, assuming to themselves, powers they are not Constitutionally granted for the express purpose of undermining the Executive. This cannot stand. Further, Roberts is unwilling to accept this is a fight he cannot win (because the Executive will ignore him and the staunch Conservatives on the court will be against him) and will leave the legitimacy of the court in ruins. That's a lousy legacy to leave behind. In the end, he is going to have to break with the Leftists, some of whom are his friends. That's tough. But the Leftists sthis fight and did it, as they often do, based on unconstitutional grounds. They have gotten away with it for decades but their time is up. Roberts can either do the right thing, even though contentious, or get flushed down the toilet of history by choosing to do the wrong thing or another BOCare type stupid decision and getting shoved aside. It's another time and Roberts needs to wise up.

It appears Roberts has already asked his liberal Secret Society brothers to refrain from Judicial overreach, but they are continuing to spit in his face. And these rogue judges are spitting in my face and the that of every American citizen who wants the laws of this Country respected and enforced. Not to mention EVERY elected official who swore an oath to the Constitution include President Trump and the rest of the Executive branch. Roberts has mad this situation much worse by his inaction, and I fear he will never gather the strength to manage this situation. If he does not, the violence and emnity will only continue and its on him!

Robert’s showed his true colors when he refused to respond to Schumer, Biden & Obamas remarks against the SC …he only responded to Trump which made him look very partisan.

The Trumpster needs to use the Rules for Radials by Saul Alinksy against this judge. RULE 5: “Ridicule is man’s most potent weapon.” In his next speech, The Trumpster needs to stop and direct someone to run this by Boasberg to get his opinion on whatever The Trumpster is proposing. And keep doing this over & over. Even have his Cabinet members do this. RULE 6: “A good tactic is one your people enjoy.” All MAGA would support Rule 5 tactics. RULE 12: Pick the target, freeze it, personalize it, and polarize it.” RULE 8: “Keep the pressure on. Never let up.” I believe the Trumpster is using this tactic for his first 100 days plan. and finally: RULE 4: “Make the enemy live up to its own book of rules.” Give it back twice as hard and go deeper too.

Judge James Boasberg issued an oral order demanding that planes carrying Venezuelan gang members, who were not even a party to the lawsuit before him and over which he did not have jurisdiction, be turned around in international airspace. Boasberg is now infuriated that his mere utterance, not even set down in writing, was not immediately obeyed. Democrats and their media have taken to crying that any disobedience of Boasberg, who was appointed by Barack Obama to apparently rule not only the entire country, but the planet and all its airspace, is a “threat to democracy” and a violation of checks and balances.

President Trump is trying to rid the country of the violent South American gang members who entered the country when Old Joe Biden’s handlers opened the southern border, and what sane person would be against such a project? [Snip] The American system, after all, was constructed as a system of checks and balances...so that a tyranny cannot develop. Yet what we have in the form of Judge James E. Boasberg and other far-left judicial ideologues like him is an incipient judicial tyranny that has no checks on its power. [Snip] Boasberg’s ruling is not the way the American system ought to work.

Federal judges are not supposed to criticize the president of the United States other than in official opinions deciding cases in which the president is a party. [Snip] The Constitution makes clear that Congress must occasionally exercise the political courage necessary to perform its constitutional duty of impeaching federal judges who seek to rewrite the law rather than interpret it. [Snip] As unsettling as the impeachment process may sometimes seem, the Constitution requires that it be sometimes used.
