For years, the legacy media (hereinafter the “Leg-Meds”) parroted the Democrats’ line that the population of immigrants can be divided into the “documented” ones and the “undocumented” ones.
The euphemism “undocumented” finally became a joke, and so the Leg-Meds and the other Democrats eventually surrendered to the word “illegal.”
However, within that category of “illegals,” they clung (bitterly) to the notion that about 99.9999999% were “law-abiding” and only the remaining 0.0000001% were criminals.
That lie was called out yesterday by President Trump’s new press secretary.

For as long as I can remember, being here without authorizing documentation was a violation of the Civil Code. When was that moved to the Criminal Code?

Legal immigrants are aliens who are not citizens or nationals of the USA, who have been granted immigrant visas, who after making lawful entry to the USA and have been granted lawful permanent residence commonly referred to as being “green card holders” who are allowed to live and work indefinitely in the USA as long as they abide by the immigration laws. Depending on their specific status, legal immigrants become eligible to apply for naturalized US citizenship after residing in the USA for either three or five years. Currently the immigration laws allow for almost two million legal immigrants to enter the USA every year. Throughout past eras just about all immigrants arriving in the USA from abroad were legal immigrants with immigrant visas or they never would have been able to board the old steamships to come across the great oceans to the USA.
Illegal aliens who are also referred to these days as being irregular migrants, or just migrants, are people who are not citizens or nationals of the USA, who have unlawfully entered the country, or overstayed their temporary admissions to the USA, or a lot of cases former legal immigrants who have committed and who have been convicted of criminal offenses that render them subject to be ordered deported from the USA in accordance with the immigration laws.
The leftist and progressive Democrats consistently have been jumbling up those terms relating to both illegal aliens and legal immigrants to confuse most Americans who do not have an insight into the immigration laws or how the US immigration system actually works. Under provisions of the immigration laws all people (aliens) who are not citizens or nationals of the USA, regardless of their age or gender, who gained entry to the USA unlawfully have committed a criminal offense, see 8 USC 1325, and when found in the USA are subject to arrest and deportation. Currently the Democrats are claiming that illegal aliens who have not committed any serious crimes in the USA should not be deported, but instead should be granted amnesty in accordance with future Democrat designed so-called “Comprehensive Immigration Reform” legislation that would put tens of millions of illegal aliens on a “Path to Citizenship” calumniating in the current illegal alien population being granted US citizenship able to transform themselves into becoming future leftist and progressive Democrat supporters and voters thus permanently changing the voter demographics of much of the USA to the Democrat’s partisan political favor.
If those Democrats amnesty and US Citizenship plans for the illegal alien populations become reality, common sense will tell you that the USA will not thereafter be able to legitimately enforce the US borders, or the immigration laws, as the USA will be flooded with unlimited millions of future illegal aliens, mainly poor, uneducated and unskilled aliens from the Third World, who would be encouraged and essentially invited to unlawfully enter the USA or overstay temporary visas to await the next big amnesty and grants of US citizenship benefits that the Democrats would surely grant to future illegal alien populations. No doubt without enforceable borders that USA will regress into becoming essentially a Third World country. Do the wimpy Congressional Republicans even have a clue? Looks like we are about to find out!

No. 5: There's not a "Civil Code" and a "Criminal Code."
The laws of the nation are in the United States Code, sometimes abbreviated "U.S.C." Some violations of that Code are criminal violations and criminal penalties are imposed for those violations included prison sentences. Other violations are mere civil violations for which other types of punishment may be imposed (including fines).

Props to #8 for clarifications. Perhaps the same could also explain the distinctions between Civil and Criminal violations, and what specifies the category to which presence without permission is specified.

No. 10: The nature of the violation -- civil or criminal -- is set forth in each provision. If the provision provides for criminal penalties such as imprisonment, then it is by definition a criminal provision.
There's no such thing as imprisonment for a mere civil offense. Section 1325(a) sets for prison terms for illegal entry into the country. Therefore, it's a criminal provision.

So getting caught entering illegally carries a criminal penalty. Getting caught just being here illegally is clearly related, but seems not to be the same. One example being those who enter legally but overstay their visa...

The Dems created this need for strict enforcement of the law. In an effort to secure future elections, they let the world into our country, including criminals, human traffickers, and terrorists. Separating the wheat from the chaff would take time that our country does not have.
