Although I often wish that Donald Trump would shut up, he has a constitutional right not to. A federal judge went too far in restricting his free expression Monday when she imposed a gag order on the former president. U.S. District Judge Tanya Chutkan, who is presiding over the Washington prosecution of Trump for his role in the Jan. 6, 2021, insurrection, ordered him to refrain from rhetoric targeting prosecutors and court personnel as well as inflammatory statements about likely witnesses. (snip) The Supreme Court has long held that court orders prohibiting speech constitute “prior restraint” and are allowed only in extraordinary and compelling circumstances.

Buck appeared on NBC News’ “Meet the Press Now” on Thursday to talk about the response to his stance.
“So far I’ve had four death threats,” he said. “I’ve been evicted from my office in Colorado — I have a notice of eviction because the landlord is mad with my voting record on the speaker issue.”
Buck added that “everybody in the conference is getting this.”

The Supreme Court on Friday took up Missouri v. Biden, the free speech case challenging the Biden administration’s efforts to censor content on social media, while issuing a pause on a preliminary injunction granted by a lower court.
Republican attorneys general from Missouri and Louisiana sued the Biden administration over its communications with social media companies related to the suppression of online speech, arguing it violated the First Amendment. (snip)
Justice Samuel Alito wrote in his opinion, dissenting from the decision to stay the injunction. “Government censorship of private speech is antithetical to our democratic form of government, and therefore today’s decision is highly disturbing.”
