A federal judge blocked the federal government on Monday from mandating COVID-19 vaccinations for health care workers in South Dakota and nine other states.
U.S. District Judge Matthew Schelp in the Eastern District of Missouri wrote in his ruling that regulations handed down by the Centers for Medicare & Medicaid Services earlier this month were issued improperly. The agency did not get approval from Congress to mandate vaccinations for health care workers, Schelp wrote, which he argued was necessary given the mandate's "vast economic and political significance." The rules were also issued without a standard period for public comment, which Schelp said the agency's justification for was not suitable.
Morningside Heights, Manhattan—A man made anti-Asian remarks after striking a woman with his bicycle’s handlebars Saturday, police said Wednesday. The incident happened about 6:30 p.m. inside the 116th Street Station in Manhattan, police said. The victim—a 53-year-old woman—was walking on the platform when the man hit her from behind. CHICAGO — The man Jussie Smollett allegedly paid to help him stage a hate crime took the stand in the actor’s criminal trial Wednesday, describing how he took part in the hoax because he thought the ‘”Empire” star could help push his own acting career.
Abimbola Osundairo, 28, told jurors in Chicago’s criminal court on day three of the trial how Smollett directed nearly every aspect of the alleged fake attack, from the racial and homophobic slurs him and his brother, Olabinjo, were to use down to who should throw the punches.

But that doesn’t stop media outlets of all stripes from doing their best to read the room. One of the major moments from Wednesday’s blockbuster oral arguments in the Supreme Court hearing on Mississippi’s law banning abortion after 15 weeks was when Chief Justice John Roberts noted that because of Roe v. Wade, America found itself in the company of China and North Korea in allowing abortion after viability was reached. This important point went completely unmentioned by the broadcast networks that took up the liberal position in support of the barbaric act.

As someone who practiced law at the Supreme Court, I listened to the arguments. I think they’ll uphold the Mississippi law. I have a few observations.
Keep in mind that oral argument at the Supreme Court is typically more theater than jurisprudence. The Justices usually already have their minds made up from reading the briefs. But it’s worthwhile theater because it connects the public to the judicial process. Also, it gives some insight into the likely decision which won’t come till next Spring.

Three federal health officials reportedly told the Washington Post the administration is readying stricter testing requirements amid concern over the new Omicron variant. The new guidance would require everyone entering the U.S. to be tested one day before boarding flights, regardless of vaccination status or country of departure.
Officials are also weighing a requirement that all travelers get retested within three to five days of arrival, as well as a proposal to require all travelers to self-quarantine for seven days, even if they test negative.

The Kenosha police released the bodycam video from when the jury bus for the Kyle Rittenhouse was being followed by a freelancer for MSNBC named James J. Morrison, who was pulled over by police and received a traffic citation. Kenosha police say they pulled Morrison over because he was following a block behind the bus, and drive through a red light at one point. MSNBC was barred from the court room after the incident. Monday on FNC’s “The Ingraham Angle,” Rep. Lauren Boebert (R-CO) spoke out about her dust-up with Rep. Ilhan Omar (D-MN), who Boebert had made disparaging remarks about earlier this year while being videotaped.
Boebert had attempted to apologize to the Minnesota Democrat but insisted the exercise was part of an effort to distract from Democrat shortcomings. “Look, Laura, I called to speak with her directly about me reflecting on my comments about her,” she said. “I had made a public statement. The three young victims slain by a school shooter in Michigan have been identified by police.Hana St Juliana, 14, Tate Myre, 16, and Madisyn Baldwin, 17 died in Tuesday's shooting rampage at Oxford High School in suburban Detroit. According to a memo issued by the Biden administration, the “White House’s Office of Management and Budget is telling federal agencies they should hold off on suspending or firing federal workers for not complying with the vaccine mandate until after the holidays.”
