A North Carolina charter school with a female principal and vice principal is violating the Constitution because it requires girls to wear skirts, a federal appeals court has declared.
The full Fourth U.S. Circuit Court of Appeals, the same court that mandated the removal of war memorial crosses in five states, said Tuesday that the Charter Day School's skirt requirement for girls is rooted in unconstitutional gender stereotypes. It is the first time a federal appeals court has said charter schools may be sued for civil rights claims, and will almost assuredly be followed by lawsuits involving sports, bathroom access, and transgender rights.

Given its membership, it would take the full Fourth U.S. Circuit Court of Appeals to address a weighty issue such as this.

Isn't attending a charter school voluntary? Don't like the uniform, don't go to the school.

I think if the Founding Fathers were here today, they would scratch their head looking for words in the Constitution that address abortion, lengths of skirts on girl students along with boys in girl's restrooms and showers in charter schools. I know it must be somewhere in the crinkled yellow document. You are welcome not to attend that charter school if the rules offend you. The judges are dumb stupid liberals creating lawsuits to follow with stupid words like unconstitutional.

Schools have dress codes, if you don’t like them, find another school! It's really simple. But I'm guessing, either a Trans guy doesn't want to wear a dress, or the daughter of a liberal, leftist lawyer wants to wear pants, and liberal leftist lawyer dad sues!

A friend was a VP at a small Christian school 20 years ago. The girls were required to wear skirts at one time.
The school board changed the dress code because it was difficult to find skirts long enough to provide proper modesty. Now the girls can wear pants. I think blue jeans were forbidden.

Simple adjustment to the rules: allow boys and girls to wear traditionally male garb — kilts.

Dress codes are set every day by the government, military, police forces, football teams, cheerleaders, bands, and businesses across the country. Even the judges in the Fourth U.S. Circuit Court of Appeals follow a dress code for judges, which look a lot like long, black dresses. But they have ruled that a charter school, alone and separate from anyone else in the country, can not set a dress code for their school. This looks like selective enforcement with no reference to any statute the school is violating.

Does the school require that the students wear uniforms or have a dress code? If so, then the students knew this when they chose to go there. If they don't want to wear a skirt then go back to the rat infested school they were assigned to.

Uniforms are apparently still allowable. One "unisex" style fits all. Prescribed pants and shirts. That this went to the courts is nonsense when there are "settled" alternatives that would have eliminated the issue.

Hang on.......ok just had to glance through the Constitution. Hmmm......nope nothing in here about the right to not wear a skirt in a school dress code. In fact nothing that says a Federal Court has the right to decide rules for a private or even public school in a state. I suggest the impeachment of the members who sit on that court.

The Court held that the School acted in clear violation of the Equal Protection Clause of the U.S. Constitution, and that sex-based dress codes like skirt requirements, when imposed by covered entities, are subject to review under the anti-discrimination provisions of Title IX.
The logical conclusion is that covered entities cannot mandate that boys must wear trousers, therefore boys can choose to wear skirts.
