It's already ridiculous that the foundation of this country relies on who the president is when one of nine geriatric Supreme Court justices either dies or retires. It's doubly ridiculous then, that a Supreme Court justice would understand this fickle structure, see its constant abuse by one political side, and yet refuse to retire when the party that most aligns with their judicial philosophy is in power. (Snip) Apparently, history really does repeat itself, as another left-leaning, 80-something year-old Supreme Court justice is refusing to retire at a time when the Democrats have a precarious hold on the Senate, and

How can this author be serious? He’s questioning the fitness of Breyer because of his age, yet a more senile, incompetent, fumbling senior, the likes of which this country has never seen, is our POTUS!
Get rid of Breyer only after Biden is removed first!

I agree, OP. Unfortunately, all the left knows how to do these days is disrespect decent people or fawn over the undeserving.

Breyer is standing in the way of the democrat radical leftist agenda! Somehow I don't think this is the type of government our founders intended.

As an old white male, Breyer just doesn't check enough of the right boxes. When Khmer Harris takes over from Slo Jo Breyer may need to hire a food taster.

Do we never question who’s writing this stuff - or do we just swallow it whole …?

Business Insider is a leftist amateur piece of excrement. And that's on its good days.
I disagree with almost all Breyer's votes on split decisions but he's smart and at least has the integrity some liberals used to have. This ageist stuff is funny. I hope he doesn't retire.

Breyer doesn't seem to be the physical mess that the sainted RBG was in her final days (although she did seem to retain her marbles) unlike William O. Douglas, and Thurgood Marshall who hung on through obvious mental impairment but ultimately retired.

A hateful article, filled with nonsense.
Breyer, whose endless babbling on the bench and on CSpan, was Dead Ted Kennedy's administrative assistant,
which tells you all you need to know.

FTA: "Democrats did not march along to former President Trump's racist and hateful endeavors, Republicans did. Democrats did not utilize apathy when it came to an international pandemic that killed 500,000 Americans, Republicans did. The Republican party isn't going through a Trump phase, that's just who they are now."
I think this about sums up Manny Fidel's (appropriate name) credibility. Feel free to disregard.

(#15 took the same quote I was going to. We must think alike.)
SCOTUS is supposed to be the rudder of the Ship of State, maintaining a course through the storm. People like Manny prefer the analogy of John Kerry windsurfing.

The Left is just freaking out that Trump or another conservative will be elected next and Breyer will croak, and get replaced by a sane constitutionalist.
They are desperate to keep their folks in the Supreme Court to permit them to do unconstitutional, totalitarian stuff.

I think many are missing the point of this article. Why do the Dem's want a judge to leave now? May Biden and company knows something that others don't. #3 and #4. Trump won't need to run in 2024. I think this audit of elections will bear out that Biden cheated and the election is null and void. The Dem's want a judge to quit so Biden can put in another liberal before Trump comes back to office. And I have a feeling that will be before 2024. I think you're going to see something this year happen. Everyone says 2024, but 2024 will never happen unless they fix this cheat problem now.

FTA: ''The longer Breyer waits to retire, the more likely it is that the Supreme Court is dominated by conservatives indefinitely.''
Um, I'm still looking for the down side of that remark.

Re #20, no one is missing the point. The Dems are antsy to get a Dem SCOTUS appointee up while Biden appears to be in charge. That is no secret. No more than Obie’s trying to shoehorn Merrick Garland in during the waning months of his lame duck period.
This is just a very lame writer. Unqualified to be an op ed writer for anything more serious than equally lame Business Insider.

But MAYBE, just maybe, Breyer knows his heir apparent du jour, has no legal integrity or knowledge credibility for the job. Few of those said to be in line have any business being on the SC - apart from party or philosophic affiliation. Kudos to Breyer - I hope he stays until he dies.

All the Supreme Court Justices have an unwavering belief in their own value to the nation. The best example was the Notorious RBG who believed she could not be replaced and hung on so long that I'm pretty sure that old girl hung on by her fingernails till ways past the bitter end. AND President Donald Trump was the one to replace her.

#20, Biden is the President and Trump is not coming back this side of a decision by either voters or their elected representatives. And I hate that people are getting disillusioned, so here is why - please write out on a piece of paper the exact steps by which Trump would come back. If it involves judges deciding it, then that is nonsense, thank God, because live by judges, die by judges, if they can analyze matters and put Trump in then they can analyze matters and take him out. If it involves the military, then that is not their job in a democracy and i would rather four years of Biden If it involves people such as Pelosi repenting that they are bad, and fixing it without being forced, then you are in la la land. The Constitution has it that this is done by Voters, and if that result is ambiguous, it is resolved by Legislatures and by Congress. if you have a better idea, propose it. But it was done that way to put the voters in charge. Those cowards? We voted for them. Their word is Final. And there is NO other way to do this. Think it over.

And yet the writer is perfectly happy to have a semi senile 78 year old President, who worries constantly that he "will get in trouble" if he answers soft ball questions, put forth a radical Leftist to "replace" Breyer, who seems pretty on the ball to me. Jus another way to [ack the Court.

The libtards are still miffed the RBG refused to retire while Soetoro was still around to pick her replacement only to kick the bucket during the Trump Administration, so now they're really starting to put the pressure on Breyer to leave while Dementia Joe is still in office. Let's hope he's as stubborn as RBG and sticks around for four more years.

The left learned a really tough lesson with RBG hanging on throughout Smidgen’s reign of error despite her crumbling health.

I'm not a fan of Breyer but do believe he is being treated disrespectfully by the Left. They are practically hounding him off the court just to cash-in their political chips. Hopefully he will dig in and refuse to budge.
