CONCORD, N.H. — A federal judge in New Hampshire issued a ruling Thursday prohibiting President Donald Trump’s executive order ending birthright citizenship from taking effect anywhere in the U.S.
Judge Joseph LaPlante issued a preliminary injunction blocking Trump’s order and certified a class action lawsuit including all children who will be affected. The order, which followed an hour-long hearing, included a seven-day stay to allow for appeal.
The judge’s decision puts the birthright citizenship issue on a fast track to return to the Supreme Court. The justices could be asked to rule whether the order complies with their decision last month that limited judges’ authority

Rule 23 requires notification of rights to not participate in the class action to al potential members. This class injunction is so broad that it includes future unborn. As the mandate in 33 cannot be satisfied, the class action is invalid

Joseph Normand Laplante
July 10, 2025
"U.S. District Judge Joseph Laplante certified a challenge on Thursday by the American Civil Liberties Union as a class action lawsuit and granted a preliminary injunction."
"The lawsuit, which was filed last month in New Hampshire was brought on behalf of pregnant immigrants, two immigrant parents and their infants."
"The ruling from Judge Laplante comes after the Supreme Court curtailed judge's ability to issue nationwide injunctions but left a door open for challengers to seek relief by filing class action lawsuits."

Didn't the Supreme Court just say that district judges CANNOT issue nationwide injunctions. That the district court rulings are confined to those judges' districts.
So, who died and made him king?
Inquiring minds want to know.

pssst...newborns, and yet to BE born have no standing, cannot communicate their grievance, nor their support, do not have the knowledge or capability to make an informed decision, nor give informed consent. IF they did, the lawsuits against Planned Parenthood would be a Class action of MILLIONS of unborn children...cruel and unusually terminated from their lives. The main "Plaintiff" in this case has spent decades and $Millions of dollars as well as thousands of hours arguing that unborn, and even living children from failed abortions have ZERO standing before any court, they argued that children could and should be given abortions, and that children that HAD been given abortions against their will had no standing to protest after the fact..

Republicans could file lawsuits --- but the Democrats have taken most of their law licenses, and the remaining are in fear of it.

If the ACLU can win a lawsuit claiming rights of the unborn then it would be easy to start a new class action lawsuit that would prevent abortions. Hats off to the ACLU!

And as a grossly unqualified and ignorant judge he gave legal standing to the unborn. So he may have delayed that birthright citizenship order a while but he inadvertantly gave the pro-life movement an in for legal challenges tp abortion.Oops...

Birthright citizenship was somebody's bad idea. It really needs to be changed to something more ligit. Citizenship just because you were able to sneak into the US and have a baby? C'mon man!

I thought plaintiffs in a lawsuit had to have standing. What standing do the plaintiffs have?

I predict 6/3. I don’t think CJ Roberts wants to be caught on the wrong side. Of the other three, two don’t care. Jackson ( don’t know what a woman is ) is shameless.

OMG...another judge and jurisdiction stepping in some dodo...just a stalling scheme by democrats...the riots are not producing the "blood" they had hoped for...and President Trump is not backing off....after his challenge a year ago...I don't see him shaking in his shoes....the democrats are so desperate that a commie is running for mayor of New York city....I'm sure the democrats can find another candidate if they try...the machine will get him elected by cheating.....like they did with ole Joe

These hyper-liberal lower court Judges can't seem to be capable of reading plain English coming down to THEM from our highest court.
I would hope that our Supreme Court would put forth nationwide a "warrant" calling on ANY judge, who wishes to defy their rulings, to put his/her name on paper and submit it prior to issuing their 'political decrees.' Subsequent to that submission, the Chief Justice could forthrightly, and with all due process, FIRE said Judge(s).

Re #5. The Supreme Court ruled that District Judges could not file injunctions. Now they are using class action lawsuits as an alternative to injunctions. Seriously, this has turned into an evil clown show. Evil clowns in judicial robes no less.

Birthright Citizenship has already been decided by Supreme Court. Both parents at time of birth
MUST be US citizens.
It’s called Precedent

A class action lawsuit typically requires a larger group of plaintiffs to be certified as a "class" under U.S. federal law .
Rule 23 also requires that the class must be "so numerous that joinder of all members is impracticable."
5 or 6 people doesn't meet that.

How does this issue provide "standing" before the court for every "single child around the country"? How do the unborn have standing? Those already born here have citizenship and are not "injured" by the EO. The courts have used "lack of standing" to avoid having to deal with so many issues, but it appears that the criteria is stretched extremely thin in this case.

Wasn't this adjudicated by the Supreme Court which upheld Trump's position? Maybe New Hampshire should to secede from the Union?
