An order published by the Supreme Court on December 13 represented a moment hundreds of January 6 defendants and their loved ones had been waiting for: the highest court granted a writ of certiorari petition in the case of Fischer v. USA. In a nutshell, after more than two years of litigation before federal judges in Washington, SCOTUS will review the Department of Justice’s use of 1512(c)(2), obstruction of an official proceeding, in January 6 cases. A “splintered” 2-1 appellate court ruling issued in April just barely endorsed the DOJ’s unprecedented interpretation of the statute, passed in 2002 as part of the Sarbanes-Oxley Act in the aftermath of the

Nice going - - really nice. The political prisoners have been rotting in filthy confinement for nearly three years - - and the "Justices" are finally showing up to do their jobs.
Take your time, boys and girls - - there's really no need to hurry.

American law and the Constitution guarantee a free trial and a speedy trial.
The j-6 Prisoners have received neither and by all rights the SCOTUS should grant them freedom.

Better yet. Overturn the convictions as unconstitutional…let the j6 prisoners sue all those involved, personally, for damages

While I am glad SCOTUS is taking the case, I am not as enthusiastic as others may be about a good outcome. This Court is not Conservative, having only two true conservatives, three radical Leftists and four wishy washies who cannot be depended on to follow the Constitution, especially John Roberts and Barrett.

I’d gladly hold Pelosi, Schumer and Cheney so the free’d prisoners could tar and feather them…before running a gauntlet. After that, they can put them in stocks for the public to poke sharp sticks at ‘em.

Only problem # 3... I wish their lawsuits would come out of the Capitol cops and FBI salaries

When you read the statute they are using, you can clearly how in (1) it talks about documents, then (2) would be obstructing the meeting about those very documents as it was set up to handle Enron type cases.
Title 18 of the U.S. criminal code, 1512(c)(2) reads as follows:
Whoever corruptly —
(1) alters, destroys, mutilates, or conceals a record, document, or other object, or attempts to do so, with the intent to impair the object’s integrity or availability for use in an official proceeding; or
(2) otherwise obstructs, influences, or impedes any official proceeding, or attempts to do so,
shall be fined under this title or imprisoned not more than 20 years, or both.
Under the above (2) that this DOJ and apparently 15 judges seem to believe pertains to this J6 incident (which lasted a total of 2-3 hours), Rep. Bowman should be charged similarly since he pulled that fire alarm with the intent to obstruct an official proceeding in the House of Representatives.

I truly believe those Prisoners should have the right to sue those who put the in Jail. Not the Government, although, in the end that is probably what will happen. They won't ever get back the time they lost sitting in a nasty Jail, but they sure as heck should wind up Millionaires for doing so!

Too late. He’s already been found guilty by the brainiacs on the Colorado Supreme Court.

" ... Is SCOTUS Poised to Overturn Key J6 Felony Count?" - don't count your chickens until you see the chicks
- Roberts is still a problem and will be waiting for his decision from the bushies
- actually I don't trust any of them except for Thomas and Alito

Just be patient folks...truth and justice is on it's way...let's not jump the gun here....the justices need to be careful while traveling and attending holiday parties...there's only a short time left for Obama to take out the conservative justices so he can...in biden's name assign another justice before he loses control of biden....and the White House...

I agree with #8. Lawsuits are becoming more and political weapons, and, sadly, in the justice system at all levels. Evidently some leftist figured out the immense power and prosecutorial discretion vested in elected DAs, etc and rich leftists started funding campaigns that would otherwise not be successful. Something has to be done to correct the widespread abuses that result.

We don’t have Justice. We don’t have Democracy. At least we have the War for Ukraine.

They should receive reparations, a million dollars a day they have been locked up. Money can be taken out of social programs, Ukraine aid, Planned Parenthood, and other Democrat pet projects.
