A federal judge has overturned the 2017 desertion conviction of Army Sergeant Bowe Bergdahl, claiming he did not receive a fair trial. The military judge in the case did not disclose that he had applied with the Justice Department to be an immigration judge after he retired.
Bergdahl received a dishonorable discharge, reduction in rank, and forfeiture of $10,000 in pay in 2017 after becoming the sole U.S. service member to be captured in Afghanistan shortly after he left his post in June 2009. President Barack Obama exchanged Bergdahl for five noted Taliban terrorists, calling the deserter a “hero” in a Rose Garden ceremony.

Based on this 'judicial' logic, Charlie Manson should have been set free during his trial when Nixon said he was guilty. Once again, there is no such thing as a Federal Judge following the rule of law. Had Obambi or Biden been president during this deserter's trial, I bet this judge Walton would have celebrated their comments.

This filthy corrupt " judge" used optics to over turn Judge Nances decision. Using the same standard everything this filthy corrupt "judge" is involved with concerning President Trump or J6ers ought to be thrown out and this filthy corrupt " judge" should be disbarred....just for starters.

A read of Judge Reggie’s Wiki bio reveals that he is tough on crime, a believer in long sentences for the guilty, and critical of the abuse of the 702 surveillance system. So why this?

Bergdahl’s old unit needs to reunite and apply their own form of justice.
I know a woman who lost her son because of Bergdahl. He was in a huge fight with the Taliban in which eight Americans were killed. They called for backup but there was none because their backup had been sent out to search for Bergdahl.

I don't understand how a federal judge has jurisdiction over the UCMJ. The way things are going in this country with federal judges, we might as well do away with jury trials and court martials and have federal judges decide everything.

It would appear that he didn't so much overturn the conviction on the two charges, but rather overturned the Punishment sentencing."...toss all orders after Bergdahl’s guilty plea". Jury selection had begun, Bergdahl decided to waive his jury trial in favor of a hopefully more lenient Judge trial, whereupon he then changed his plea to guilty.
New Military Judge could decide Bergdahl deserved a MUCH harsher penalty. Up to Life in Prison.
It is "Interesting" that this comes up as a similar circumstance is taking place in North Korea.

Good men were killed, because of the desertion by Bergdahl. The Washington federal judge is unworthy of the title, and a reprobate.

Bergdahl entered a guilty plea. There was no question of guilt since he plead guilty. The only question should have been his sentence. Now, the question is what happens next? The Biden DOJ is weak. The Biden administration will probably appoint Bergdahl to some special office within the Joint Chiefs to become the "first" deserter appointed to a high ranking military position.

He was not "captured." He went looking for the Taliban in order to join them, and they decided to let him live with them but wouldn't give him a gun.
He should have faced a firing squad when he got back to the U.S. military,
