As the midterm 2022 elections approach, the expectation is that, with thirty Democrat House retirements and the continued unraveling of the Biden Administration, the Dems are about to experience historic losses in both the House and Senate.
However, the evil geniuses within the Democrat party have identified the Fourteenth Amendment as a vehicle to thwart Republican dreams of achieving a massive political realignment. Therefore, it may be shortsighted to count the one-time party of Jefferson as down-and-out until the last glimmering frenzy has been extinguished.
In 1868, the Fourteenth Amendment was amended to add Section 3, also known as the Disqualification Clause.

Agree with the original poster but the spineless GOP will do nothing.

Republicans may do nothing, but MAGA will fight to the death for the USA! Time to choose sides, either be for America or live under the communist rule that is growing daily.

The author of the article is former ACLU member which tells you a lot. The ACLU is anything but for America. American Thinker is becoming a stinker.

Just my opinion; I would like to wish that someone would punch Mark Elias in the nose and break it. He is a very unscrupulous individual. Thus he aligns himself as a dummy DEM.

I'm of the firm opinion that Democrats and their Globalist alies are so selfish and self-centered that they will eventually push the rest of us, too far.
The idea of a Civil War is terrifying, esecially when you know one side will use nuclear deterent on their own people, if they feel like it.
Yet day by day my anticipation of making these murdereous narcissists pay, grows.

Well, I guess that means that we could use it on Commie-la for helping to bail out Antifa/BLM thugs who were burning, looting, murdering people and assaulting law enforcement in blue cities all over the country.

I remember my parents who grew up in the 60's who told me about the "hippies" who were "progressive" an how they felt that they should be allowed to speak their ideas. Now those same "hippies" are out to silence those that allowed them to speak their ideas, though repulsive to the conservatives. Now those "hippies" are out not only to destroy OUR right to free speech, but to destroy us the people as well. Any dissenters must be destroyed by them. The "hippies' are now trying to destroy those that allowed them free speech. Maybe my parents generation were wrong. If they had done to them what the hippies are doing now we would not be in this mess. God would be praised and evil repelled. The "hippies" were and are the evil.

The current version of the democrat party is not the one that Jefferson belonged to. Same with my grandparents. Their versions of the democrat party vanished decades ago. What exists now is a morphed and decayed death cult party, out for all the corruption and rot they can embrace.

This original add-on to the 14th Amendment was hastily pasted on the bill because Robert E. Lee (a Democrat) was still so popular in Virginia they feared he'd easily become a Senator if he ran. (He wasn't interested anyway.)
Most of the Congressmen at that time also were afraid that many other Southern Generals, Governors, etc. might quickly come back into Congress. Of course, they were all Democrats who were being blocked. How ironic.
The OP is correct in that cooler heads prevailed and people calmed down enough by 1872 to realize the "War Between the States" was over for good and Southerners could now elect whoever they chose. Besides, it probably would not have survived a Supreme Court challenge. Free speech issues and all.
By the way ... no Southerner was ever charged with treason and most were granted full & complete pardons if they simply re-pledged allegiance to the Union in front of the flag. Bobby Lee was actually fully pardoned by President Ford due to a clerical oversight.

The key Constitutional phrase is: "No person shall be a Senator or Representative in Congress..."
We are back to who is in control of this process. The amendment DOES NOT SAY that such persons may not be on the ballot or even elected. Each chamber of Congress is the final arbiter of qualifications...not state or even Federal courts.

I think President Trump is right as he said last night in his speech to CPAC...WE must watch the democrats every day and never count on their playing by the rules...the only way they can win...is by cheating...and crooked hillary is waiting in the wings to take over...watch the fake news as they court her...it's sickening...but folks...this is the game WE're in now...and WE can win...dig in and fight for freedom...the Washington swamp is full of puffed up politicians who are in a panic and will do anything to win....

Not a single one of these office seekers has been convicted, much less even charged with insurrection.
It's all sound and fury.

I agree with several other posters, we should turn the tables and use this against the democrats. The insurrection was the illegal changing of voting laws and the outright other cheating on Nov.3, as well as the coup attempt on Jan. 6 to portray it as an insurrection by the MAGA crowd while it was infiltrated with FBI goons and antifa and Nancy denied National Guard troops. The left are the insurrectionists if anyone is.

Isn't it interesting that the democRAT party, which usually considers the U.S. Constitution as an annoyance inhibiting their plans for a Socialist government now wants to use it to maintain control?

ACLU = All Communist Lawyers Union.
-----------------------------------------------------------------
Marc Elias = Nathan Reed of Wolfram and Hart
Perkins Coie = Wolfram and Hart law firm.
For those of you unfamiliar with the 'Buffy the Vampire Slayer' / 'Angel' Television show universe, Wolfram and Hart is a powerful law firm, headed by demons and dedicated to advancing evil throughout the world.

FTA: In 1868, the Fourteenth Amendment was amended to add Section 3, also known as the Disqualification Clause. It holds that no member of Congress or a state legislature “shall have engaged in an insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”
This is why the Democrats and their MSM acolytes started pushing the "insurrection" nonsense Jan 6, 2021.
This is why former Capitol Police Chief Steven Sund was DENIED the additional reinforcements he asked for at least 6 times, and why he was blamed for the failure of higher ups to provide adequate security on that day. Sund resigned, and since then we've learned a Capitol Policeman shot and killed an unarmed protestor, while others on the force appeared to facilitate/permit protestor entry into Capitol buildings.
A political party that spent four years pushing the Trump Russia Hoax would have no problem thinking ahead, and limiting security in a way guaranteed to create lots of chaos and arrests. This isn't rocket science.

They can try, but as described in the article, the Amnesty Act of 1872 clarified and removed the office-holding disqualifications in Act 3 of the 14th Amendment. The GOP and the affected candidates need to get on this hard, fast and LOUD!!
