‘COVID Relief’ Bill Collides
With the Constitution

Original Article

Well, that didn’t take long. The first major bill passed by the new Democratic congressional majority and signed into law by our new president on March 11 had already provoked a constitutional challenge by March 17. The attorney general of Ohio filed suit against the Biden administration last Wednesday in the U.S. District Court for the Southern District of Ohio, alleging that the American Rescue Plan Act (ARPA) unconstitutionally and coercively limits the right of states to manage their internal fiscal policies: “This suit challenges an unconstitutional provision in the American Rescue Plan Act — a provision that allows the federal government to commandeer state taxing authority.”

Nothing new here. The crazies don't do things in accordance with the Constitution. For all we know Biden has voided the Constitution with one of his "executive orders"! The Constitution was violated numerous times in the unlawful seating of Biden as "president' and they continue to violate it with every bill they pass with the assistance of biased Federal Judges. If the current laws of the land are not enforced there is no hope for the future of our Nation.

God bless Attorney General Dave Yost of Ohio! "“The Tax Mandate thus gives the States a choice: they can have either the badly needed federal funds or their sovereign authority to set state tax policy. But they cannot have both. In our current economic crisis, that is no choice at all. It is a metaphorical ‘gun to the head.’ ” Its time to turn the hyperbole of the commies against them and weigh them down with time-consuming law suits. Lawfare can go both ways if a Republican official is not a member of the Uniparty's Stupid Wing.

#2 - keep in mind that Yost is really complaining about having a limit placed on the tax burden imposed upon the citizens of Ohio. As Ohio is one of the major recipients of taxpayer dollars in the Blue State Bailout, Yost is not being patriotic or altruistic. He is fighting for a bigger piece of the Federal handout.

in other news, Ohio Governor, Michael DeWine, remains clearly on the fence when it comes to defending the rights of Ohioans. As a 2 term US Senator, US Representative and Ohio Attorney general, DeWine has become a spineless leader when it comes to Covid, He seems to prefer to follow the lead of Newsome, Whitmer and Cuomo. He wants to be a big state, battle ground state governor but he doesn't want the notoriety that comes with it. in stead he is happy to let the Ohio attorney general (Dave Yost) lead and draw the flack while he twitters in Columbus, pretending he even has a clue. I sure hope this is DeWine's last term. By the way, what caused DeWine to leave his entranced US Senate seat and flee back to his Ohio farm and hide out. DeWine couldn't summon the courage to defend (or oppose) Trump and now he can't defend his own citizens,

Here in Idaho we have a $600 million surplus in taxes collected and the legislators are being very slow in returning any money/taxes to the people despite being pressured to do so. This money collected is due to escalating property values and 6% grocery tax. Next door, crazy CA does have prop. 13 where politicians can't raise more than 1% a year property taxes, not so in Idaho...so the old timers who live here resent the newbies who are driving up their property taxes. And so with this so called "stimulus bill" Idaho legislators can use this to keep the 600 million dollars and not give their citizens a tax break. Unconscionable!

I do not have much hope of this going anywhere. After John Roberts refused to hear the case about unconstitutional changes to state election rules by judges and bureaucrats, John Roberts will refuse to hear this case. The U.S. Constitution clearly states that state legislatures are responsible of determining the rules for conducting elections in their states.

If you think this violation of the 10th Amendment is a problem now just wait until the "gubbermint" demands that you not only GET the Chinese flu vaccine but you must also carry a card proving that you have gotten vaccinated! Your new I.D.# will then be verified against a national database and you will not be permitted to move anywhere without showing your "papers". And if you lied and aren't in the database --- or have forged a vaccine certificate ---- then you will be fined and/or arrested. Just like Nazi Germany circa 1944.

The leftist Democrats, who are almost all lawyers, knew that vast portions of their so-called COVID relief bill was unconstitutional, but still voted it into law. The leftist Democrats are betting that the US Supreme Court today does not have the intentional fortitude to overturn the portions of their COVID relief bill as being unconstitutional.

Fresh off of ramming through a $1.9 trillion monstrosity of a stimulus bill stuffed with pork spending and liberal pet projects, Democrats are gearing up to try to radically transform our election system and lock in majorities at every level of elected government for decades to come. Democrats call this bill the For the People Act, or HR 1, but a more appropriate name would be the Corrupt Politicians Act because it’s designed by the politicians, of the politicians, and for the politicians. Here are just a few of the countless reasons why this bill may be the single most dangerous piece of legislation we’ve seen in decades:

President Joe Biden's agenda has stalled on Capitol Hill halfway through his first 100 days in office. Biden's supporters fear that if Democrats in Congress don't act soon, they will have squandered their best opportunity to pass such policy priorities as a climate action bill, election legislation, and immigration reform. Supporters are especially frustrated with Senate Democrats for allowing their chamber's Republicans to filibuster bills passed by the Democratic-controlled House. The Senate, unlike the House, permits a minority of its members to block bills supported by a majority. Specifically, Rule 22 requires three-fifths of the Senate (60 senators) to vote to end a filibuster by invoking cloture on a bill.

"The border is closed," he told "Fox News Sunday." It was a preposterous statement. Everyone knows the Biden administration is struggling to find places to accommodate the more than 15,000 unaccompanied minors who have crossed the border illegally in the last few weeks.

Well, that didn’t take long. The first major bill passed by the new Democratic congressional majority and signed into law by our new president on March 11 had already provoked a constitutional challenge by March 17. The COVID-19 pandemic and lockdowns have not only been devastating for society, they have had a chilling effect on the scientific community. For science to thrive, opposing ideas must be openly and vigorously discussed, supported, or countered based on scientific merit. Instead, some politicians, journalists, and (alas) scientists have engaged in vicious slander of dissident scientists, spreading damaging conspiracy theories, even with open calls for censorship in place of debate. In many cases, eminent scientific voices have been effectively silenced, often with gutter tactics. People who oppose lockdowns have been accused of having blood on their hands, their university positions threatened, with many of our colleagues choosing to stay quiet

For a sense of how credible West Virginia Sen. Joe Manchin is on protecting the filibuster, consider a 2018 campaign ad wherein he brandished a rifle and declared himself to be “Second Amendment always.” This ad allowed him to maintain the illusion that he was a gun-totin’ Mountain State patriot while he parroted the Democratic Party line. Manchin’s ad failed to mention that he twice introduced gun control bills during his first term. Moreover, he is once again working on gun control legislation. Sen. Manchin’s pledge to protect the prerogatives of the Republican Senate minority by supporting the filibuster is no more trustworthy than his support of the Second Amendment

Before President Biden took office, the Pfizer and Moderna COVID vaccines had been authorized for use (with another, from Johnson & Johnson, on the way) and were already being administered to people around the country. Typically, it takes 10 years or more to develop a vaccine, but here were two vaccines against a deadly virus that took less than a year from inception to finding their way into people’s arms. Variously marketed as a “pandemic relief bill,” an “economic stimulus package,” and the “American Rescue Plan,” it is largely a wealth transfer from well-managed and prosperous red states to incompetently managed blue states. A mere 9 percent of the legislation’s $1.9 trillion cost will be devoted to mitigating COVID-19, and about 12 percent will go to individuals in the form of stimulus checks and unemployment payments. The rest will go to blue state bailouts, funding for school systems that remain closed, kickbacks to unions, new subsidies for Obamacare, and exorbitant financing for innumerable pet progressive projects.
