President Trump granted a pardon to Michael Flynn, his former national-security adviser, today. Flynn had pled guilty to lying to FBI agents about conversations, during the 2016 transition, with the Russian ambassador about sanctions. Flynn’s pardon should bring to an end one gross violation of the Constitution’s separation of powers, even as it gives rise to groundless accusations of another.
Although Flynn had pled guilty, the circumstances of the case had raised serious concerns about whether the government had proceeded properly. The FBI, for example, questioned Flynn even though it did not appear he had violated any law. In May, Attorney General William Barr ordered the case dropped.

If Biden gets a shot at a Supreme Court nomination I would not be surprised to see him nominat Judge sullivan.
If not for this biased moron no Pardon would have been necessary.
We all know Flynn pleaded guilty because he was railroaded into it, because they had destroyed him financially.

This political persecution of General Flynn engineered by the Obama-Biden Administration was improper from the get-go, as the FBI had no legitimate reason to go into the White House without notifying the White House Counsel to interview Flynn about a telephone call that he had with the then Russian Ambassador. That’s because the FBI at the time had a complete written transcript of the telephone call in question. The only reason that the FBI would have was to get Flynn to answer in a way that did not comport exactly as shown in the transcript, with the object of prosecuting Flynn criminally for lying to the FBI. To compound the illegitimacy of what the FBI did is that the original report written by the FBI agents is reportedly “lost” and the FBI agents who interviewed Flynn said that they did not believe that Flynn lied to them. Still the Robert Mueller team of Democrat lawyers went ahead to criminally prosecute Flynn. As it stands now, with all the partisan politically maneuvering that has been going on in the Democrat dominated District Court and the DC Court of Appeals to delay the disposition of the Flynn case beyond the election hoping that Biden would win. So who is to say in keeping what has been going on that the clearly partisan liberal Democrat Judge Emmet Sullivan will except Trump’s pardon as being constitutional or legal! We will see.

And had the FBI ever entered the 20th century with **recorded** interviews? That seems like a simple reform of longstanding malpractice that should have been implemented immediately. WAS IT DONE?

Forgotten is the fact that Flynn had no clearance to meet with the FBI (or anyone) from VP Pence, who was heading the transition, although he was supposed to notify his "boss" of any meetings. Then he lied to Pence when asked, which resulted in his dismissal. (Later Pence walked his determination back, which leads to the question of whether Flynn lied, or Pence exercised erroneous judgement.)
Flynn was a victim of hubris. Presumably, had he been honest about his meting and his apparent lobbying for Turkey, for which he was charged with failing to register as a foreign agent, this could have been met head on. But, he was an important guy, a patriot, a GENERAL, and he trusted the FBI. He stupidly failed to have a lawyer or even a witness present for the "friendly" interview. Then he got caught in the who-said-what game, slammed with multiple charges and threats to prosecute his son. He rolled over. He pled guilty twice, to two separate judges, and swore he was indeed guilty and acting of his own free will with no pressures. The second time, when Judge Sullivan took over the case, he was given extra time to consider what he was doing...and he told the Judge in open court that he was guilty...under oath. But, perjury is no big deal. He was protecting his son. Sentencing was delayed by mutual consent between DOJ and Flynn as their agreement was contingent on cooperation. Only now, with the case held open, did the FBI and DOJ come forward with exculpatory evidence...at the demand of Judge Sullivan. Maybe the judge was peeved royally by the consistent lying by all parties in his court, jamming his docket, and now being presented with a "nevermind" while DOJ still had charges that were never filed...and could be in the future. (That foreign agent registration complaint, for one.)
You can put Flynn in your Valhalla. It seems very apparent that he bought everything in his bag of legal troubles long before Judge Sullivan showed up. And now the actual truth of this sordid matter will be forever lost, reduced to chapters in self-promoting memoirs.

John Yoo is a well-known, distinguished conservative jurist. His article is simply explaining the Founders' rationale behind the President's wide pardon powers, and in so doing supporting the Flynn pardon. If any of my fellow posters had read this article graciously posted by OP, they might have even learned something.
