Federal Court Overturns Nation’s First
Natural Gas Ban

Original Article

A Ninth Circuit court on Monday went against a Berkeley ordinance that banned natural gas piping in new buildings inside the city. A district court had dismissed an action from the California Restaurant Association, a dismissal that is now reversed by the Ninth Circuit court, according to its published opinion on the case (pdf). The California Restaurant Association alleged that the Energy Policy and Conservation Act preempts the city of Berkeley’s regulation, which banned natural gas piping in new buildings. The Act expressly preempts State and local regulations on the energy use of natural gas appliances used in household and restaurant kitchens, according to the Ninth Circuit judges’ opinion on Monday.

Wish I could replicate Spike Jones' laughing record right about now. Suffice to say I'm ROFLMAO. I finally installed a wonderful gas stove in 2022. Made, of course, by General Electric. Now there's an object lesson for someone.

The court didn't strike it down because it was a demonstrably stupid ordinance, they struck it down because of federal primacy. I'm of the opinion that local communities and states should have the right to blow themselves up. Failures provide lessons, economic opportunities to the not as stupid and entertainment for the non-residents. Berkeley won't learn a thing. I half expect that they will tax or punish what they can outright ban.

Banning gas stoves would destroy the restaurant industry. Whatever will Governor Hair Gel do when The French Laundry closes down?

Judging by the bunches of wild, whooping teens swinging through the trees of Los Angeles, California is a lost cause no matter what happens with gas stoves.

mixed emotions here. glad to see the 9th District strike down the ruling whatever the reasoning but would just as soon see the morons in Berkley reduced to eating cold meals or waiting longer to eat. BTW - isn't the former 9th 'circus' producing more reasonable rulings since Trump replaced several of the judges?

The 2nd Circuit Court of Appeals on April 20 issued a temporary administrative hold on the return date of the House Judiciary Committee’s congressional subpoena to Mark Pomerantz, a former prosecutor at Manhattan District Attorney Alvin Bragg’s office. Pomerantz investigated former President Donald Trump’s finances before leaving Bragg’s office in February 2022 in protest of Bragg’s initial unwillingness to bring an indictment against Trump. Bragg then brought the indictment against Trump in late March, prompting Rep. Jim Jordan (R-Ohio), chair of the House Judiciary Committee, to initiate a probe into what Jordan calls a “politically motivated” prosecution against a former president.

Some insider threats are more equal than others; so goes the position of the nation’s biggest leaker of classified documents in modern history, and it’s not Jack Teixeira. This story shows the importance of what was hidden by the combined efforts of the national security apparatus in 2018. Readers here are familiar, but most Americans are not, with how Senate Intelligence Committee Chairman Mark Warner leaked a top-secret classified Title-1 FISA application in March of 2017. Then the Vice-Chair of the SSCI, Senator Warner instructed Senate Security Director James Wolfe to leak the 82-page FISA application assembled against Carter Page.

The television host on Tuesday invited on his show Duke University's William Darity, who co-authored the book 'From Here to Equality: Reparations for Black Americans in the Twenty-First Century'. Darity suggested the US government issue the funds in much the same way it sent out checks to millions of Americans during the onset of the COVID-19 pandemic, at a cost of $14 trillion.
