Thursday, during an appearance on Hugh Hewitt’s nationally syndicated radio show, Gov. Ron DeSantis (R-FL) criticized President Joe Biden’s student loan forgiveness proposal.
The Florida governor said not only was it a policy “disaster” in that it threatened to make economic problems worse. He predicted it would be a political “disaster” because of the public’s reaction.
“Oh, I thought it was terrible,” he said. “One, it’s unconstitutional, which is obviously something important. I don’t think that that’s something Biden cares about, but he doesn’t have the authority to do this. Ben Domenech calls it “unconstitutional flimflammery.” Sounds about right. The proper authority to forgive student loan debt is the same authority that authorized the program in the first place: the United States Congress. But Biden — like the last four presidents — is ignoring Congress because it’s too damn slow, and besides, they talk too much.
This is true, but that doesn’t make it any more constitutional. “The president proposes; Congress disposes” is the old adage from my high school civics class. Biden is doing a lot of disposing of student loan debt with a fig leaf for justification.

In addition to the observations Scott and John have entered below, a few additional thoughts:
• Invoking the HEROES Act as the legal justification for student debt forgiveness reminds of Franklin Roosevelt invoking the World War I-era Trading With the Enemy Act as legal ground for his “bank holiday.” At the time everyone was so dumbstruck and panicked that no one thought to raise a legal challenge, but that’s surely not the case today, though I do wonder if legal challenges may founder for lack of standing. As expected, President Joe Biden made a unilateral move Wednesday to implement a student loan forgiveness plan that “will include at least $10,000 in loan forgiveness for borrowers who make less than $125,000 annually, as well as another payment freeze for roughly four months.” While Republican members of Congress are understandably outraged, most of the ones openly speaking out against Biden’s move seem to be studiously avoiding the “i” word (impeachment) even though that is an option that should definitely be on the table considering Biden does not have the authority to carry out this plan, which does an end run around Congress and the required legislative process.

The Biden administration suffered a blow Tuesday when a judge of the U.S. District Court for the Northern District of Texas blocked guidance from HHS that abortion services in life-threatening or health-saving situations must be provided and will be protected if those actions violate state law. U.S. District Court Judge James Wesley Hendrix (a Trump appointee) that the guidance from HHS is “unauthorized.”
The Biden administration, the most pro-abortion administration in my lifetime, thought it had found a way to go around some of the restrictions on abortions that pro-life states are putting into effect after the Dobbs v Jackson Women’s Health ruling by the Supreme Court.

Homeland Security Secretary Alejandro Mayorkas put the final kibosh on his disinformation governance board on Wednesday, after a review he ordered came back with a firm recommendation that the idea was a stinker.
The board had been on hold since May, when Mr. Mayorkas hit pause after a botched rollout that saw critics accusing him of Orwellian attempts to silence people who had competing views on issues of the day.

Justice Department officials assume they can't rely on what former President Donald Trump's lawyers say given Trump's volatility as a client.
That's according to The New York Times, which reported that department officials had been in communication with Trump's representatives for months while trying to recover hundreds of pages of government records that were improperly moved from the White House to Mar-a-Lago after Trump left office.
