In a 5-4 decision, with Chief Justice John Roberts and Justice Brett Kavanaugh siding with Justices Elena Kagan, Stephen Breyer, and Sonia Sotomayor, the U.S. Supreme Court allowed the Biden administration to end the “Remain in Mexico” policy. -snip-
According to federal immigration law, the federal government is supposed to detain immigrants while they await the hearing of their case. However, Congress has never allocated enough money to detain the rising number of illegal migrants who need to be detained.

There would be no need to use a public health provision like the remain in Mexico provision to keep illegal aliens from entering and staying in the USA unlawfully if the Biden Administration would effectively enforce the basic immigration laws that they have not done since assuming office.
If this US Supreme Court ruling supporting the Biden Administration plans to keep USA borders open to all comers from all over the world who have entered the USA unlawfully and then make spurious claims of eligibility for asylum in the USA causes a massive increase in illegal aliens coming across the borderline unlawfully this Summer and Fall, that circumstance is bound to cause a huge adverse political action against the Biden Administration and the Democrats in general in the November election. The contention that all those illegal aliens intend to pursue legitimate asylum claims in the immigration courts is bogus, as Biden has told the world that he will no longer enforce the deportation provisions of the immigration laws against illegal aliens in the USA that has encouraged and invited the current out of control situation along the borderline, no matter if the individual illegal alien’s asylum claims are denied by the courts. Essentially the Biden and Democrat plan is to allow just about every illegal alien who wishes to just stay in the USA, to become legalized through a series of Democrat designed “path to citizenship amnesties” that will grant them them US citizenship, U.S. voting rights, expecting very high percentages of those poor and uneducated current illegal aliens to become future socialist Democrat supporters and voters.
Those Biden and Democrat non-enforcement of the immigration laws plans will also cover the tens of millions of foreigners who enter the USA with temporary visas, or with visa waivers from all over the world each year, who will no longer be required to depart from the USA after their supposed authorized stay in the USA expires. Once foreigners do that, they are considered to be illegal aliens, and as such would be eligible to also apply for a Democrat designed “path to citizenship” amnesty, U.S. Citizenship and U.S. voting rights.
The Biden and Democrats non-enforcement of the immigration laws plans have the objective in the long term to change the USA voter demographics in enough places throughout the USA by flooding the country with illegal aliens who mostly all will fit within one or more of the racial, ethnic, gender, LGBTQI, and other categories of Democrat identity politics, thus increasing the future socialist Democrat vote by the tens of millions ensuring that the Democrats will permanently control the Congress and the White House indefinitely on into the future.

If the feckless repubs ever regain power the very first thing ought to be the listings of every law violated by the regime and enforce those laws. Starting with mass deportation.

This Supreme Court refuses to get caught up in political issues. Is what the Government is doing "right"? Of course not. And the law is such that Executive Orders can alter matters, with the proviso that Congress can always legislate otherwise or cut funding. The rules of the game now allow authorities to detain, but there are no adequate facilities nor the money to do so. So, they release. Congress, that great meeting place of the UNIPARTY, has no interest in doing anything but kicking up dust and taking in your contributions and votes. In fact, no one has any interest in returning our "friends" home, except a segment of America seen as racist and deplorable. But it's not these people condemning scores of humans to death by suffocation and overheating...it's the "humanitarians" among us. Price of doing business.

I can understand the ruling. It never became law because it was not voted on. However isn’t there a law that says you can refuse entry until it is shown that the person does not have a contagious disease. Years ago didn’t we quarantine people before they could enter U.S? Can someone refresh my memory on this?

Perhaps it will be a blessing in disguise. It is to be hoped that things get so bad, the public won't be fooled by the media and the democrats about how things are just hunky dori. And we can vote those idiots out of office, in spite of our stupid Republicans.

The liberals/Roberts/Kavanaugh reasoning was faulty. Their point seemed to be that “remain in Mexico” put a strain on diplomacy, presumably with Mexico while Mexico’s leaders continued to permit these invaders from other countries head across Mexico to invade the United States.
And since when did the Supreme Court concern itself with diplomatic relations with other countries?

Many seem to not understand what Remain in Mexico was all about. I’m seeing confusion in Replies.

As for Title 42, which had to do with Covid/disease, a federal judge killed Biden’s attempt to do away with it. It remans in place.

The problem is not the Supreme Court. The blame lies entirely at the feet of our US Congress who wrote a law giving the government discretionary power so that it 'MAY' enforce immigration provisions. It is another example of our feckless lazy-assed representatives who write laws which let the executive branch and bureaucrats decide how to rule our country.
