A U.S. Marine veteran won a 20-year fight against his homeowners’ association (HOA) to fly an American flag on his property. Richard Oulton, a Vietnam veteran of the U.S. Marines who resides in Virginia, began his legal fight against his HOA in 1999, when the HOA told him he had to take down his flagpole because neighbors said his flag caused a disturbance to the community.The Marine veteran took his case to court and lost his case the first time around. He took Old Glory down in 2003, but he continued to fight for his right to honor his fellow

It wasn´t about flying the flag, it was about how he did it. You don´t need to erect a 30 foot pole to fly the American flag! And you don´t need to fly one the size of the car dealers to be patriotic. It´s perfectly acceptable to fly Old Glory attached to a structure, like a house. It was the POLE not the FLAG that was he issue. Our HOA has a similar prohibition, and that includes HAM Radio towers. How would you like your neighbor to fly the ISIS flag from a 30 foot pole? If you allow one to do it, then it opens the door, and I know because I was on our HOA Board for over a decade.

Here´s my advice, READ the HOA documents BEFORE signing the mortgage papers. Otherwise move out if you don´t like it. It´s a contract, like any other. It´s why people don´t legitimately whine about their car payments after they bought the car.

Mr. Oulton didn´t "win" anything. It was a SETTLEMENT reached apparently AFTER the courts ruled in favor of the HOA, forcing him to appeal twice.

Another source informs "The HOA in 1999 was under the control of the developer. Now, it´s at the hands of the homeowners. ´They asked us to poll our neighbors and we pulled all of the neighbors that were adjacent, nine houses and was 100 percent support,´ explained Oulton."

I am a Marine who during 1967 participated in support of several operations involving 1/9, the unit Richard Oulton was a member of and is honoring by flying Old Glory on his property. I agreed with him until I saw the picture of the flagpole. It is huge. A flagpole that size is better suited for a public square or a commercial property like a car dealership not a residential neighborhood. His patriotism and desire to honor those he served with is commendable and understood by this old Jarhead but the impact that mammoth pole has on his neighbors must also be considered. In my opinion, a more reasonably sized flagpole is called for. It would serve the same purpose.

I don´t know why anyone buys/moves in to homes with HOAs. Typically, it seems the HOAs are run by nazis, people who let the power go to their heads. Yes, sometime residents do somethings atrocious, but more often than not, it is the HOAs who abuse their powers.

I commented on a article above this one. Here you can´t find a home without an HOA. It´s not the rules, it´s the miserable Nazis running the HOA. Every neighborhood has a miserable person who wants to make everyone else miserable.

This harassment has to stop. We need to amend the ADA to include HOAs cannot take the home of an elderly or disabled person. To think an HOA can put a lien on your property and take a home for a few hundred dollars and resell it is beyond cruel. Sign the petition on the WH petition site.

HOAs are totalitarian, and attract folks who just LOVE telling others what to do and exactly how they MUST do it, just that simple. Folks who don´t mind conforming to someone else´s views about how they need to arrange their homes, yards, cars and life will put utp with it, even like it.

Folks who want actual freedom, defined by YOU deciding what you want, not some committee´s ordering you to do what they want, will not like it.
