The disqualification of former President Donald Trump from the ballot in several states may depend on whether the U.S. Supreme Court believes that the president of the United States is an “officer of the United States” according to Section 3 of the 14th Amendment to the U.S. Constitution.
Trump, the leading candidate for the Republican presidential nomination, was disqualified from appearing on the primary ballots in Colorado and Maine after the former’s Supreme Court and the latter’s Secretary of State Shenna Bellows, respectively, ruled that he was ineligible for federal office under Section 3 of the 14th Amendment.

I would think the most relevant question would be whether January 6 rises to the level of an insurrection.

As a bonafide coward, Our Chief Justice will punt. Trump will win because though the court will not be willing to rule whether Trump is an officer or immune as having been the President on Jan 6. No, Trump will narrowly win because he has not been tried and convicted of any crime - as yet. That will of course force those conducting 'lawfare' to speed up their efforts hoping to secure a conviction before next November.

I would think the real question is has Trump been convicted of insurrection?
He was tried and acquitted in the Senate on those charges and never charged in a court.

Section 5 of the 14th Amendment to the U.S. Constitution
The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.
Absent action by the Congress, by appropriate legislation,
to enforce the provisions of the 14th Amendment to the U.S. Constitution,
neither the Colorado Supreme Court, nor the Secretary of any State
have any authority to reach into the 14th Amendment
to sanction anyone for anything...

This article must be shadow banned where I'm at, cannot link to it. Everyone, including Democrats, knows this is political, and the U.S. Supreme Court needs to deal with it, get it done.

Whatever decision that Weasel CJ Roberts and SCOTUS gives will be as narrow as possible.
Since Trump has not been charged or convicted of "insurrection" by Congress as is defined by the Amendment, ballot challenges will be rendered moot.
Could be 9-0, but a narrow, focused decision.

There is a very simple reason that the writers of the 14th Amendment did not include former Presidents in their list of those disqualified under the amendment. Only one former President, John Tyler, had supported the Confederacy, and he had died in 1862.

The relevant question for 2024 is, will the people blindly go along with the democrats' nonsense like they did in the last election or will they insist on doing what is right? The Legal System is broken, in case you haven't heard.

Officer of the United States or not. That is the last question to decide; the Left is again moving the goalposts. Officer of the United States is IRRELEVENT. The first question is WAS THERE AN INSURRECTION on Jan 6 to overthrow the government?
NO!
Did Trump, by instructing his supporters to be peaceful and patriotic, incite an insurrection?
No!
Was Trump ever indicted or charged for inciting a insurrection?
NO! The bogus Jan 6 Committee of Pelousy tried unsuccessfully to impeach private citizen Trump for this hyped-up "crime," but failed. Even the FBI has repeatedly said that there was absolutely no evidence of an INSURRECTION.

Couldn't Biden be charged under this clause? He's allowing terrorists, cartel members and other foreign criminals into this country. He's also taking money from, and showing extreme weakness to, our enemies.
