A judge in Massachusetts on Friday ruled against a lawsuit that questioned the state’s ban on assault weapons and large-capacity magazines, declaring that the weapons were not protected by the Second Amendment. Assault weapons are considered to be military firearms, U.S. District Judge William Young said in his ruling, therefore disqualifying them from being included in a citizen’s right to “bear arms.” Policy makers, rather than the courts, were better suited to decide on the regulation for the weapons, he said. "Other states are equally free to leave them unregulated and available to their law-abiding citizens," Young said in his

The judge is an ignorant fool. There is no basis whatsoever for this "military guns are not for civilians" crackpot idea. This is exactly opposite the intent of the 2ndAm.

In the first 2ndAm case, the SC, in Miller, said a sawed off shotgun wasn´t protected because it wasn´t a military arm, and only military arms were protected by the 2nd Amendment.

In Heller , the SCOTUS held that any weapon on common use was protected. AR15s are one of the highest sales volume designs in the last 20+ years. This WILL be overturned if it reaches SCOTUS.

Yet another in a long list of reasons to institute strict term limits on ALL Federal judges at ALL levels. This particular lout, born in 1940 by the way, has been drawing a judge´s salary since he was confirmed in 1985! Read that again. Thirty Three years!

According to this "judge" muskets would have to be considered assault rifles since they were used by Continental soldiers, but civilians used the very same rifles, too.

Up through the Civil War, every weapon available to the military was available to the public. This included cannon, bombs, swords, armor, even war ships, could be purchased and maintained by private citizens, provided they obeyed the laws that left levying war to the government.

The rifles that the leftists refer to as being military “assault weapons” are nothing more than semi-automatic firearms. The only difference between those so-called ”assault weapons” and all other semi-automatic handguns, rifles, shotguns is the way the “assault weapons” look to the uninitiated, as they function mechanically the same as all other semi-automatic firearms. If this judge can simply order the semi-automatic rifles referred to by the leftists as “assault weapons” banned, why not all other semi-automatic firearms, handguns, rifles, and shotguns that operate mechanically in the same way? That would mean banning just about all modern firearms being possessed and sold to law abiding citizens in the USA in the modern era, thus making the Second Amendment functionally inoperative for personal defense purposes.

OP is exactly right. The shortest way to explain the Second Amendment to a person sincerely trying to understand it is this:

The Second Amendment protects the rights of citizens to be as well armed as their government.

Liberal judges appear increasingly incapable of sincere understanding. If idiots like this judge had been alive during the revolution, we would have been shooting at Red Coats with Silly String.

The article isn´t clear.
Did the judge say that it wasn´t a violation of the second amendment? I realize that a lot of people refer to the article of the fourth as the second amendment, but there is no second amendment to the Constitution, so if he did, his ruling is meaningless.

#3 may have hit the nail on the head but let´s hope his pessimism is off base - other firearms used by the military (i.e., "military firearms") include 9mm handguns and 12 gauge shotguns. And as the law-abiding citizen ranted in Greensboro the other night, anyone carrying an AR-15 into combat would be dead within minutes due to lack of firepower - it is not a military firearm.

Back in the day the Constitution was written, a musket was an "assault weapon" and if Gen. George Washington had been given AR15´s and the ammunition to defeat the bloody British faster, he would have used them and allowed every Private to General Officer to keep them in their homes as protection, especially as the British would come back in 1812 and burn down the White House. One more reason to make darned sure that the Dems do not regain a majority in EITHER Chamber, especially the Senate, in case another SJC seat opens up... it´s very likely.

We need another Conservative/Constitutionalist on the bench. Urgent.

Too many people lose heart when under constant attack. Our response must not be discouragement and then disengagement, but a renewed fervor to keep this still floundering Ship of State off of the rocky shores.

Best-selling author Stephen King put down his pen on Monday and picked up his phone, sending a scathing message that made light of First Lady Melania Trump’s kidney condition and bashed President Donald Trump. “Not to be snarky, but Melania can probably use a week’s rest from Blabbermouth Don,” wrote Stephen King in a tweet sent to his 4.8 million followers. “Sounds heavenly to me.” (Tweet) The Dark Tower writer’s screed came within hours of the news that Mrs. Melania had received treatment at Walter Reed National Military Medical Center for a benign kidney condition.

No man in America is more entitled to the nation’s admiration and gratitude for sacrifice than John McCain. He’s a hero in anybody’s book, with no asterisks. An exclamation point, but no asterisk. The criticism of a young White House aide was harsh for remarking, in a private working session where everything was off the record, that since the senator was “dying, anyway,” he should not be in the calculus for reckoning how the vote might go in the confirmation of Gina Haspel.
