Don’t know if this means it’s a delay on hearing the case or if it’s a now or never thing. But, if it’s about waiting I would say that they are probably trying not to become the decision point on a highly political issue. If I were a scotus Justice I would rather that the issue be hashed out on Capitol Hill than in the court. That being said, I’m of the opinion of everyone else here, that the original executive order was unconstitutional to begin with. Seems straight forward. But, the court is still a right leaning entity, so how is this explained?

Easy, Obama´s order´s expired when Trump was elected. Trump has taken no action -- and his no action causes Obama´s orders to expire. The courts cannot vacate a no action. So what is the case?

The funny thing is the rulings by the activist liberal Democrat federal judges against President Trump actually hurt the DACA illegal aliens chances to get a permanent congressional fix (amnesty) as those court decisions took the pressure off the Congress to act before March 5, the date that Trump was to terminate DACA.

The reason that Trump set up his March 5 deadline to terminate DACA was to pressure the Congress to provide a DACA fix in favor of the DACA illegal aliens. Those court decisions served to undermine that Trump political strategy and were obviously politically based.

The Obama instituted DACA defacto amnesty was unconstitutional from the get-go as the President does not have constitutional authority to make up his own immigration laws. If the President could do that, he could simply allow all illegal aliens to remain in the USA.

That is clear, because the US Constitution specifically grants the authority to decide what the immigration laws will be to the Congress.

Time for President Trump to refuse to obey the Supreme Court and all of the lower courts packed with democrat communist party activists intent on destroying are Republic.

This is where another battle needs to be fought and won in the Civil War taking place right now in our country.

President Trump needs to act like s DemonRAT and ignore the judge(s). To paraphrase Jackson:

The judge made his ruling, let him try to enforce it

Maybe Trump could create an Executive Order:

This administration will not be bound by lower court rulings. Any federal law or Executive Order must be challenged at the Supreme Court level. Lower courts are not the proper place to adjudicate anything that affects the entire nation.

If Congress won´t reel in these activist judges who think they have the right to write law, then the President should try an E.O.
