Sounds like the Judicial Resistance may also include the FISA Court. Have there been any reports of the judges reading the riot act to the DOJ and FBI Coup Plotters.

This is truly the fault of the Rebublicans. Congress has the power to define what cases the circus, er, circuit and appeals circuit courts can hear. Congress should mandate that all cases involving an executive order goes straight to the Supreme Court. Those lazy 9 will be apoplextic. They will have to hear hundreds, maybe thousands, of cases instead of the usual 8 or 9. However, liberals will soon learn that they can´t get a cherry picked judge to issue law from the bench and most of these nuciance suits will go away. Also, by taking powers away from the courts, the lower judges will realize there is a check and balance system and either they start acting like judges, and not blacked robed demigods, or have even more power taken from them.

This is the kind of thing that can take down a country. When our last resort, the Courts, discard the rule of law in favor of their own political biases, we have no place to go. It can be seen in jury nullification, too -- people adjudicate according to their biases, not according to their duty as jurors and Judges.

Does the Separation of Powers preclude having activist judges arrested for meddling where they have no designated power?

There must be some limiter, as these guys are appointed and can hold office for decades.

I believe Lincoln put a couple under house arrest, and Roosevelt threatened to pack the courts that were inimical to him, if they didn´t vote his way.

From the Constitution Article 3 Section 1
"The Judges, both of the supreme and inferior Courts, shall hold their Offices DURING GOOD BEHAVIOR......"

Does anyone ever read this? And what is good behavior? Is it just someone who has been caught in a felony crime? I read that if a judge in NOT following the Constitution or the laws passed by congress and signed into law by the president they are NOT following good behavior. As such, could be impeached and removed for the bench. And put a stop to this type of "judging".
