A federal judge in New York ruled Tuesday that the government must fully restart the Obama-era DACA deportation amnesty and accept brand new applicants as well as renewals, throwing a potential wrench in the ongoing debate over the fate of “Dreamers” on Capitol Hill. Judge Nicholas G. Garaufis said the administration does have the power to revoke DACA, but it must give a sound reason for doing so — and the Homeland Security Department’s September 2017 rationale fell far short of what is required in that regard. He even used Mr. Trump’s own tweets as evidence that the DACA program was ended

What a bunch of horse manure. It really is rich that that judge (of course appointed by a Democrat, Bill Clinton) is ordering the restoration of that fraudulent program when it is unconstitutional to begin with! I am so confused by this because the Supreme Court ruled on DAPA (the similar program related to parents) and let an injunction against it stand from the Fifth Circuit. Link below. Of course, this ruling will be struck down, As usual. But, the President should simply ignore the ruling, declare his power over his Constitutional domain and dare them to take him to the SCOTUS for "abuse of Power"- Of course, they would not because he would win. and that would shut them up once and for all.

Garaufis acknowledged it would be best if elected officials — rather than judges — settled on a solution for DACA.

From my reading the judge feels the administration did a poor job laying out it´s case and needs to try again. Trump can take another shot at it.

The failure to comply with an illegal order, that is, one that was unconstitutionally enacted, is grounds for this federal judge to order the compliance with the illegal law? Where is James Traficant when we need him? Beam me up Scotty.

DACA was unlawfully implemented with an executive order. And executive orders are not laws. As such, EO´s can be cancelled, amended. Postponed or extended at the will of the President. Judicial approval is not needed, required or wanted.

DACA was not even an “executive order”. As I recall Obie had Napolitano do a DHS “policy memo” to take care of a temporary problem as Obie’s DREAM Act had never passed the Congress.

PDJT should just ditch it entirely. The judge overreached.

This is insanity in the courts. DACA was already ruled unconstitutional and the SCOTUS let the decision stand. A federal judge can´t overrule the SCOTUS.

I thought that Obama´s illegal DACA proclamation expired naturally on March 5, 2018.

Trump just declared that he would make no attempt to reaffirm it, and tossed it to Congress to do their job.

While not on point with the article, but relevant regarding PC. This is Black History Month. Cable and network are airing numerous films involving black issues. The overriding theme is black oppression by white people and the best revenge is to kill white people. I cannot imagine young people in high school and younger grades watching all these films without believing that white people are bad. I wonder...have they aired "Biko", "Cry Freedom", "A Time to Kill" (based upon a true story of a white attorney defending a black man wrongly accused of rape and murder), the film clips of the horrendous treatment of Clarence Thomas by the press when his strongest supporters were all white and "To Kill a Mockingbird". I am just waiting for numerous clips of Rodney King.

I would think that a race would want to honor their race by highlighting the contributions of their public figures, athletes, actors, writers, scientists and doctors of which there are plenty. Like I said, somewhat off point but very related to the issue.

Just pretend it never happened. Let the little judge stew. He has no ability to enforce this outrageous overstepping of the separation of powers. DACA was an unconstitutional Exec Branch deal, cancelled by Exec Branch. Judiciary has nothing to say.

This strikes me as really pushing for any excuse to attack Trump for any reason whatsoever. CNN has a whole story devoted to shaming Trump for calling the Parkland shooter a “sicko” on the grounds that it’s stigmatizing to people with mental health problems who aren’t all mass shooters of children. Two people who work to prepare food for students at New York University have lost their jobs for serving a meal featuring food and beverages believed to be stereotypically associated with black cuisine. The New York Times reports: On Tuesday, a dining hall at New York University advertised a special meal in honor of Black History Month. On the menu? Barbecue ribs, corn bread, collard greens, and two beverages with racist connotations: Kool-Aid and watermelon-flavored water.
