A Ludicrous Ruling That Trump Can’t End DACA
National Review Online, by Josh Blackman

Original Article

Posted By:MissMolly, 1/11/2018 4:52:41 AM

On January 20, 2017, the executive power peacefully transitioned from President Obama to President Trump. At least one judge in San Francisco didn’t get the memo. Yesterday, Judge William Alsup ordered the Trump administration to keep its predecessor’s Deferred Action for Childhood Arrivals (DACA) program in place. This remarkable 49-page order has all the aesthetics of a judicial decision but is, at heart, an amateur act of punditry. Judge Alsup paints the picture of a divided White House, wherein “the Chief Executive publicly favors the very program [his Administration] has ended.” Citing a “presidential tweet,” the court suggests that DACA’s

Look on the bright side. When CA finally slides off into the Pacific, the 9th circuit will go with it.

Jeff Sessions is not responsible for the impeachment of the judge. The House of Representatives is, and with a positive vote to impeach, the matter is sent to the Senate, where a 2/3 majority is needed to remove the judge.
What Jeff Sessions can do is to have the Solicitor General file an expedited request to the U.S. Supreme Court to handle the immigration issue. The Court, in turn, can do what it did to the 9th circuit back in the 1990s on a death penalty case.A. It can instruct the circuit to stop ruling on pending immigration issues. And the order can apply to all circuits.

A democrat socialist POTUS can enact DACA but a Republican POTUS cannot reverse that decision. Gee wiz perhaps that´s why we have a congress and a constitution so we have a consistent form of government and don´t become a completely different nation with every change at the top.

And it´s important top note that Trump, rather than doing as Obama did and abuse his power, correctly handed the issue to congress where it belongs.

Trump should just say, "This is the reversal of an illegal executive order, and is beyond the perview of the judiciary, entirely an Executive Branch issue."

Then ignore their tantrums.

No, don´t appeal it to higher judicial bullies : just defy it. No one in black robes - including SCOTUS - has authority in this matter.

POTUS: just rescind DACA now. No deals, no waiting, no March deadline. Just rescind it.

THen it´s time for repatriation of the "kids", with their parents/family/faux families. When their Congressional advocates (advocates for ILLEGAL aliens) whine about these "kids" only knowing English, well, their parents still speak their native languages. They´ll do fine!

Send them home in an orderly fashion, but speedily, starting with the most recent arrivals. Then they can begin the process of applying for temporary alien status or green card or something.

Norm Macdonald, in addition to being the best Weekend Update anchor ever, is also a keen student of human nature. Last year he summed up the results of the 2016 presidential election with this koan-like observation: "People hated Hillary Clinton so much that they voted for someone they hated more than Hillary Clinton in order to rub it in." I really think that sums up our current moment. A lot of people, myself included, underestimated just how tired of Hillary everyone was. After a quarter-century of listening to that awful old criminal´s angry, scolding voice, America finally said enough was

President Trump, apparently, is open to rejoining the Trans-Pacific Partnership (TPP). Yes, that TPP, the same multilateral trade deal that Trump savaged during the 2016 presidential campaign and withdrew the United States from in the early days of his administration. Last week, during a meeting with farm-state lawmakers, the president said his administration would revisit the deal and instructed advisers to look into the matter. Of course, it’s hard to know whether to take the overture seriously. Tuesday night, Trump threw cold water on the idea via Twitter, expressing a preference for bilateral trade deals. Regardless, rejoining the TPP is a

It’s a pretty safe bet that, with the possible exception of former First Lady Barbara Bush, the two private citizens who most dominated the legacy news media this week were Southwest pilot Tammie Jo Shults and former FBI director James Comey. Both have occupied positions of trust for decades, but it’s pretty clear that only one is actually trustworthy. Read the following and try to decide which of the two possesses genuine character: On Tuesday Captain Shults contacted air traffic control shortly after 11AM and, after identifying her Boeing 737 as Southwest 1380 and noting that it was carrying “149

In a victory for the longstanding Wall Street "Charging Bull" statute, New York City Hall announced the "Fearless Girl" statue will soon move to a new location three blocks away. "Fearless Girl" was commissioned by the investment firm State Street Global Advisors to advertise an index fund. In March 2017, it was placed in front of the iconic bull statute, a piece of guerrilla art celebrating American entrepreneurship created by Italian immigrant and Free Beacon Man of the Year Arturo Di Modica. The statute immediately went viral as a feminist icon, with the bull being recast as a symbol of the patriarchy.

Twenty-five years ago today, FBI tanks smashed into the ramshackle home of the Branch Davidians outside Waco, Texas. After the FBI collapsed much of the building atop the residents, a fire erupted and 76 corpses were dug out of the rubble. Unfortunately, the American political system and media have never faced the lessons from that tragic 1993 day. Fifty-one days before the FBI final assault, scores of federal Alcohol Tobacco and Firearms agents launched an attack on the Davidians’ home spurred by allegations that they had converted semi-automatic rifles to full-automatic capacity. The ATF’s lead investigator had previously rejected an offer

It´s also inducing a bit of post-traumatic stress disorder among Democrats, many of whom consider the fired FBI director the villain of the 2016 election. Comey´s near-omnipresence on the air and online to promote the release of “A Higher Loyalty” complicates, if not undermines, Democrats’ effort to capitalize on the feud between the president and the nation´s former top law enforcement official.
