One wonders what would have happened if the Sweet Cakes by Melissa case involved not the owners refusing to be coerced to violate their religious conscience by providing a cake not to two same-sex people celebrating their union and calling it a marriage, but rather a Muslim bakery being forced to bake a cake decorated with a cartoon picture of the prophet Muhammad covered with bacon sprinkles. Would the bakery in that scenario be forced to pay a heavy business-killing fine for actually believing that the Founding Fathers meant freedom of religion when they enshrined it in the First Amendment?

This is just so wrong. People will be looking for those with strong religious feelings and will use this to get them to violate their beliefs. I may be wrong, but I believe I have read that these folks were targeted by the gays.

Seems like if no one has the "Cakes" needed to challenge the Mooslim Bakers to test the equal application of the law....then...the government panzies and wafflers are inviting Christian Bakers to commence a program of decapitation and random violence against innocent people so that they will be granted equal justice, under the law. If that strategy (Violent Jihad) works and is not challenged by the authorities then it would, logically, proliferate. If those who live in peace are stripped of their rights then the government is demanding more violence.

The basic issue is: Do customers have more rights than business owners? Can a business require, by law, that customers patronize their business? Can they require them to buy certain products?

Customers can go elsewhere if they don´t care to patronize a business, so business owners must be allowed to refuse service to customers they don´t care to serve. Business´ already have rules that prevent customers from being served. One example is the sign that says: ´´No shirt, no shoes, no service!´´

I went to art school in Philadelphia in the early 70’s when all of the gays were beginning to come out of the closet. There’s a reason why it’s called The City of Brotherly Love and my school was chock full of gays.

I never had an issue with them, believing in Live and Let Live until they became so militant and acceptance led to special treatment and special rights which led for a demand not just to accept but to celebrating every aspect of their perverse lifestyles.

Their tactics have led me to become intolerant of all of it. BLM is doing the same when it comes to blacks, which is a shame because I know full well that it is not the decent hardworking blacks who are giving the whole race a bad name.

So long as We The People passively permit the lie that the Constitution means what some unelected judges say that it means, cakes celebrating homosexual perversion may well be deemed to be a constitutional right. Just as taxpayer funded abortions for ILLEGAL ALIENS have been. Or many other lunatic notions. Logic and objective truth don´t enter into the matter. Indeed, I was once lectured that "facts is RACIST!". So expecting wisdom and good sense from judges is like expecting to find a good meal in a wagon of cow plop: yeah, it is conceivable in an infinite universe, but it´s not the way to bet.
Start FIRING some judges!

I agree with #4 completely. To my dismay, I have seen posts on this site suggesting that when a business owner receives a "business license" (where is that in the Constitution?), he/she surrenders all other rights. Absurd!

Remember, this is Oregon, a state run by a a government almost as goofy as California´s. The sad thing is, the Supreme Court will continue to avoid ruling on the lower court´s decision.

#8 - When you take out a business license you subject yourself voluntarily to the public accommodations laws applicable in your business jurisdiction. In Gresham, Oregon, the business owner expressly agrees that "The business shall comply with all Federal, State and Municipal laws. Conducting business in violation of these laws...may result in denial or revocation of the business license." That´s the clear deal, and these laws generally bar discrimination on the basis of everything from age to sex and gender to race and religion. Oregon law includes sexual orientation, which means if you make wedding cakes for straights, you make them for gays or anyone else, or you are in violation of the law.

Yeah, pretty absurd. These same Oregon laws expressly require service to police officers and service members. Apparently some folks don´t want to serve them, either.

There is absolutely no reason why any store owner should be forced to do business with anyone.

I disagree with Sobieski because I believe there is an implied Freedom of Association in the First Amendment. See N.A.A.C.P. v. Alabama(1958) and Boy Scouts of America v. Dale(2000).

What we see are people/groups forcing association by political actions, bringing the weight of public opinion to bear on business, organizations, groups, churches, etc. that will not do what they think they should do not what they want to do by their own convictions.

Like many other things, we tolerate in this country the right of association is being destroyed by the communist/socialist progressive thought. Diversity and PC are culture killers.

Re #12, as I recall the bakers would do a regular wedding cake. They just would not do a custom wedding cake that involved particular design elements specified by the couple.

The case has come down to redefining public accommodation. Can no line be drawn - no line whatsoever? Think about it.

I wish the Supreme Court would make a ruling (on the Colorado case) that would set a precedent for all these "discrimination" cases:

"No state or local law, nor any ruling by a board created by a state or locality, may abridge any Constitutional Right, as enumerated in the Constitution and Bill of Rights. No state or lesser government can make a ruling contrary to national law.

"Therefor, a person, entity, or business that advertises or makes known that they follow religious precepts cannot be forced to violate said precepts."

Of course, being the contrarian that I am, I would also like to see a punishment to "activists" who drive past a company that would serve their needs to find a company that won´t be eligible for triple the "damages."

AS for the business licence angle: A state says you will comply with all laws (ETC), the the state passes a law that is in violation of your constitutional rights to certain freedoms. Obviously, many state laws are so, especially the abortion laws, the various decency laws (no nudity in public) etc. What if a radical gay couple came into the bakery and demanded a phallic shaped cake penetrating an anus shaped cake. Could anyone be forced to make such a design against their will. The design is the thing in question. So, if that ran against anyone´s reasonable sense of decency, why would a state be allowed to define anyone elses limits on decency, as in the case of the bakers in question? Decency is not defined by the State- it is defined by the individual. So, can the state mandate what is or is not an offense against religious sensibilities? Obviously Colorado and Oregon seem to think so. I vehemently disagree. No bully state should be allowed to insist on how people view and think of decency or religion.

The fact that he offered a standard cake with no problem seems a crucial point. Seems that any sort of a "public accomodation" requirement would be met by a standard cake, and that a custom made artistic cake would be more clearly a free speech issue than a public accommodation issue like refusing to serve a minority in a restaurant.

Of course, the intent is to grab all Christians by the throat legally and force them to say how much they love the fact that homosexuals flaunt Biblical teachings, and make Christians fear admitting their religious convictions, and show how wonderfully "normal" homosexuals are.

#12 - So, if you are to conduct any business in Oregon or anywhere else, if you are to ply your trade and skill, and you must obtain a license from the state to do so, then you surrender your Constiutional rights? Is that what we have come to? By such logic, there can be no individual liberty as one pursues happiness and property. Basically, in order to obtain one´s sustenance, one must obtain permission from the state to do so, and in doing so MUST surrender their birthright as American citizens.

That is oppression at the most basic level. What´s really sick about it is that the people, by their consent through their representatives, believe that this is supporting freedom. The Rule of Law is not absolute. Otherwise Jim Crow would be the law of the land, and the advancement of the dignity and liberty of so many would be restrained by the notion that we MUST surrender to such tyranny.
