An appellate court Thursday upheld a penalty against Oregon bakery owners who refused to make a cake for a same-sex wedding almost five years ago. The owners of the since-closed Gresham bakery - Aaron and Melissa Klein - argued that state Labor Commissioner Brad Avakian violated state and federal laws by forcing them to pay emotional-distress damages of $135,000 to the lesbian couple Rachel and Laurel Bowman-Cryer. Ok, let´s see a Jewish baker have to bake one for a Nazi celebration. One can come up with lots of examples where it really is absurd that the government can force someone to do business with anyone who walks in the door demanding whatever they wish. Hope they appeal this typically Leftist decision. BTW the super liberal, Brad Avakian is a complete horse´s behind in every way. Talk about emotional distress -- what about the emotional distress caused to the bakers by the gay couple and the courts? That beats any "emotional distress" the bakers caused the gays by refusing to bake their cake.

According to the judge, "they have made no showing that other people will necessarily experience any wedding cake that the Kleins create predominantly as ´expression´ rather than as food,´"

Which explains why people pay a premium for a wedding cake as opposed to just buying an ordinary cake for their wedding, because after all it is just food.

This could have all been avoided and yet the bakers could have maintained their belief. I used to be in business for myself. I turned away a number of customers because I did not like them or their life style, and they never knew why. I "suddenly" became much too busy to fill their order, or do the service call they needed. No law says I can´t do that.
I can also so over charge with the initial estimate the customer will go elsewhere. Again no law stopping me.
If I had said I´m not doing it because you´re a particular color or gender or "couple" then they have a leg to stand on.
I feel bad they´re getting "legally" mugged and robbed. There are no thought police yet that can read my mind.

If you’re 4th amendment rights are violated, do you know how much you are entitled to in a lawsuit? Virtually nothing, unless you got the crap kicked out of you in the process. Some rights are more equal than others. Apparently rights that appear nowhere in the constitution are worth a lot more than ones that are clearly enumerated.

The court;´s definition of ´art" is badly flawed. If their definition was accurate, then the NEA would not have been able to define the crucifix in a jar of urine as art. Or do they expect a majority of people have to define cake decorating and sculpting an art- or just one person? What part of the word ´decorating and sculpting´ does not fit the definition of the word ´art´? Is religion, as protected in the Constitution subordinate to some arbitrary State law that defines ´sexual orientation" as a protected clause? The SCOTUS will have to decide this, I suppose, when the bully tyranny of the State is able to trample an individual´s so protected rights. This is wrong- and it should not have to be decided by the SCOTUS. It is wrong on face value.

#9- Indeed, emotional distress for the bakery owners that is far beyond the alleged emotional distress of the lesbians; two women whose feelings were allegedly hurt, but seemingly lack feelings for the livelihood of a Christian couple--subjecting Aaron/Melissa Klein to emotional and financial stress appears to be inconsequential in their minds. It would be interesting to follow the money: Aaron/Melissa Klein quite likely must use and possibly deplete their life savings to cover litigation costs; what is the financial source for legal expenses on behalf of the lesbians? ACLU?

While we wait for this case to get to the Supremes, shouldn´t we be able to walk into a Halal butcher shop (no pun intended) and order pork barbecue? It´s just food after all.

Imagine using this ruling to shut those places down and hound those ghouls back to where they came from. Maybe the leftists would think twice.

If skill and artistry were not the key reasons for choosing a bakery then why not whip up a cake from a cake mix? I wouldn´t even say go to your grocery store bakery; they, too, attempt to decorate and embellish their food product!

The Supreme Court has a very similar case right now involving bakers in Colorado. If that case is decided in favor of the bakers in Colorado the case against the Oregon bakers will be moot.

Failing that I think #19 may have the only remaining option.

The case currently under consideration by the Supreme Court has a baker who was obviously being TARGETED for his beliefs.

The person wanting the gay cake could have chosen over 60 other places but didn´t. They drove over 100 miles out of the way in fact.

The Oregon case is about wanting to FINANCIALLY RUIN the bakers instead of protecting their 1st amendment rights of conscience. Certainly, there are other places that could have baked the cake.

This would have stood under Nobama, but the court is supposed to be above party agendas and driven by the Constitution and State laws. The idea that they should just accept it and pay the fine is repugnant to most.
