After criticism by some local officials of a new program that refers people caught with four ounces or less of marijuana for fines and community service, El Paso, Texas, Police Chief Greg Allen turned out to be a surprise defender of bypassing the usual criminal justice rigmarole of booking, mug shots, and jails. While careful to emphasize that he´s no fan of drug legalization, Allen says it´s a waste of his officers´ time to put hours into an "an arrest that has no end result of a conviction because of jury nullification."

And that´s good not just for Denver residents, but for anybody who is willing to take advantage of the often-annoying demands of jury duty to throw a little sand in the machinery of our intrusive government.

Jury duty is part of our responsibility as citizens as we must be judged by a jury of our peers. I wonder how Tucille feels about the juror nullification that sent double murderer O. J. Simpson out onto the street, free as a bird?

It should come as no surprise that the writer is the son of a well-known (deceased) libertarian, who was a major player at libertarian Reason, and writes under his father’s name.

You get the good results with the bad results. Jury nullification is one of the last restraints the people have upon an insular, arrogant, deaf government, before the shootings/hangings start.

If you are ever on a jury - the entire trial is about how to give you the least exposure to what really happened as possible.

Every time they are about to reveal an important truth - they make the jury get up and leave the room while they lawyers and Judge decide what NOT to tell the jurors.

I am 100% in favor of jury nullification, evn if it occasionally lets a murderer off the hook (OJ). A jury won´t do that nearly as often as a judge will.

Jury nullification ultimately means that your judgment is in the hands of 12 average citizens like yourself. Even taking human error and folly into consideration, your chances of justice are better with 12 average citizens than with 12 law school graduates.

As Bill Buckley said at the height of his brilliance, "I would rather be governed by
the first 2000 people in the Boston phone book than the entire faculty of Harvard."

Let justice be done. Amen.

@1, the O.J. verdict had nothing to do with jury nullification (which is the finding by the jury that a defendant is not guilty of any crime even though they broke the letter of the law). Rather the O.J. verdict was a product of a corrupt police department and prosecutors´ office being revealed during the trial.
I believe that O.J. was guilty, but that the attempts by the police and the prosecutors to strengthen their case by manipulating the evidence gave the jury no choice but to find him "not guilty".

Better 100 guilty people go free than 1 innocent be convicted. I hated the deceit which let OJ go free but I´ll take that over and over recognizing the importance that a jury has (at least in theory) keeping the government in check.

It is rather hard for a juror sitting there making $5 a day, while the judge is making $150K annually, and the lawyers $200 an hr.

Jury nullification seems to be OK as long as the jury nullifies laws you don´t like or defendants you like go free. But if they nullify a law you favor or free a defendant you don´t like, it´s Armageddon!!

I was called for jury duty for a DUI. When asked, I honestly stated I believed in Jury Nullification and, if the prosecutor could not prove impairment--not just blood-alcohol levels--I would not vote to convict. I was dismissed and have not been called back for jury duty.

That was 23 years ago. Coincidence? Maybe, but...
