A federal judge on Monday permanently blocked President Trump’s executive order to cut funding from so called “sanctuary cities.” Trump’s order would have removed some federal funds from cities that limit their cooperation with U.S. immigration authorities. U.S. District Court Judge William Orrick rejected the Trump administration’s argument that the measure only applies to a relatively small pool of money. Orrick also said that Trump cannot set fresh conditions on spending that Congress has previously approved. Monday’s ruling came in lawsuits brought by two California counties, Santa Clara and San Francisco.

Once again... The Supreme Court needs to stop these political rogue, activist judges. How can one lower court judge "control" the Executive Branch? Bueller?

Who cares? There´s always going to be a judge to say what the left wants because they´re embedded throughout all levels of our former judicial branch. Start seriously rounding up illegals and deporting them. Have their hearings on the bus as it travels to the border so there´s no time for a "judge" to intervene. Empty out construction sites, meatpacking, farm fields, lawn care and cleaning businesses. What about whole neighborhoods where illegals are stuffed in 20 or 30 to a house? Quit writing up executive orders and DO something!

The Government no longer has to pay your salary.

I recall one Federal Judge rescinding Obambi´s Executive Order that banned some offshore drilling. Obambi simply ignored the Judge and issued a new Executive Order with the same language. The only thing Obambi never ignored was the mirror.

Where was the ´Distinguished Judiciary´ when a crazed and angry Barrak was fencing off National Monuments to prevent WWII veterans from their only chance to visit ?

Is there not a single Judge in the land who will play front man in support of Good Governance....while there is always one or more available to thwart such efforts ???

Absurdity tier 1) A municipality or a state can openly defy federal law enacted consistent with the powers granted to the federal government by the constitution.

Absurdity tier 2) A federal judge can affirm the position of the rogue municipality or state joining in the defiance of federal law, by blocking limited measures on the part of the federal government to impose consequences for breaking federal law.

I reckon that will serve as a clear indication that we are operating as a banana republic without our full complement of republic.

Tell me again how we are one nation and we should compromise reach across the aisle yadayadayada. When the left doesn´t get their way they just take it like a 2yr old taking a toy from another child.

At least the new reality is that "sanctuary cities" are, for the Border Agents, synonyms for "target-rich environment".

More important is getting rid of the Obama/Bush holdovers in upper management. Reassign them to Fairbanks Alaska.

The integrity of these appointments to follow the law written in the US Constitution and its statues is being politicized rather than adjudicated under law.

That is why some should actually recuse themselves when they don´t follow the law and should be removed if they don´t.

Another reminder that, over the long haul, 90% of the ballgame depends on the make-up of the federal judiciary.

Those who have done their homework may properly argue that the Founders never intended for it to be this way, but it´s what we´ve got and changing things is going to be a long term proposition.

I think the law is a problem here. Once Congress appropriates funds, the Executive cannot choose to select who gets them or not unless the law has selection criteria. Long ago the courts held against President Nixon who tried to sequester federal funds. Gutless Congress needs to pass legislation denying federal funds to sanctuary cities. Right now the Executive´s only option is to prosecute those who violate federal law, but it´s not politically savvy to start prosecuting sheriffs and D.A.s

Agree with OP. However, the "normal" process is glacial at best. The way to "expedite" is to ignore Orrick´s order and implement the executive order. Then the matter will be addressed by SCOTUS post haste.

I think Orrick is one of the judges who also stopped the immigration executive order. Who elected this POS judge president. The Supreme Court needs to get this activist liberal in line or he needs to be removed from the bench.

Congress has the final say over which cases may be filed in which level of the court system.

In Congress supported the Constitution they could pass a law saying the Supreme Court is the only court able to rule on Executive Orders, as an EO concerns the whole country.

By the same token (as stated by poster #24) Congress needs to pass legislation denying federal funds to sanctuary "cities" (or "anything.")

I am not an attorney which is probably the only known sin I will not have to atone for when I die. So, resorting to the methodology of common logic the following question arises. How can sanctions on sanctuary cities be unconstitutional when sanctuary cities, themselves, are unconstitutional?

A trial court judge can´t permanently block anything. The decision can be appealed and the appellate court can stay it temporarily from going into effect. Not unless and until the Supreme Court refuses to hear it, or upholds it, is the judge´s ruling permanent.

It really irritates me to have to agree with the ruling based on the reasoning.

However, FUTURE funding can be withheld.

The plague of empty seats which has befallen the National Football League reached biblical proportions this week, as teams continued to find it hard to fill stadiums. Naturally, a large number of players also continued their anti-American protests during the playing of the national anthem as Week 14 rolled into stadiums everywhere. And as a result, ticket prices are plummeting.
