I am cheered by a story from Friday that seems to have received little notice. (snip) The allegation that Oberlin officials knew or should have known that racism was not a factor in the arrests, and yet allowed and facilitated students in deliberately damaging the business future of the bakery, should open the door to punitive damages. The purpose of punitive damages is deter future misbehavior. Therefore, the sum awarded as punitive damages needs to be big enough to matter to the defendant. Oberlin College enjoys an endowment of over $800 million, or almost $300,000 per student, which will sound mighty

Anyway, Oberlin is my alma mater, but I´m 100% behind the plaintiffs. The college administrators obviously went to the Mike Nifong School of Social Justice.

I´m sure Oberlin carries all sorts of "umbrella" insurance and its endowments will not be touched by any award, most likely a quiet settlement behind a gag agreement. I bet Oberlin is a major employer and economic entity in Lorain County, Ohio, hit by de-industrialization. The locals aren´t going to kill one of their golden geese, especially if the number is already shrinking.

Kudos to Mr. Lifson for sharing his always welcome and highly respected valued insight regarding the contemptible effort by Oberlin College and Meredith Raimondo to accuse David and Allyn Gibson of racism. Hopefully, the plaintiffs will be blessed with superb legal counsel to bring the suit to a favorable resolution on behalf of David and Allyn Gibson.

Put the guilty administrators out of business for life and sting the college´s endowment. Many insurance policies specifically exclude deliberate bad behavior from coverage. I certainly hope that is the case here.
