The law says the crime is based on gross negligence. Intent is not a factor. Even Comey in his statement on not charging her said she had extreme negligence in handling classified material which in my view is the same level as gross negligence or possibly higher. He based his decision on not finding evidence of any intent. Total rewriting of the law and a massive coverup. Lock her up. Then lock him up. Lock them all up.

The other day the judge praised Mark Geragos, the (flaky) lawyer who is representing Colin Kaepernick in his “collusion” lawsuit against the NFL owners.

That tells us a lot about Judge Napolitano.

That said, I hope he’s right on Hillary but will not hold my breath.

There is one system of justice for rich and politically powerful Democrats. And another for everybody else. And, it wasn´t just Clinton who disregarded our laws and didn´t give a hoot about our nation´s security, it was the entire Obama Administration and many federal agencies which are packed with career government workers who are almost all Democrats.

The judge is right about the line of play: investigate thoroughly, line up your case based on what the investigation yields, and finally make a decision about whether or not there is a winnable case against her. That was precisely the process that Comey (and probably Lynch) short-circuited back in July 2016.
As for Napolitano’s bona fides as a judge, he was first-class. I served as a juror in his Newark NJ courtroom and I never encountered another judge as courteous, orderly, and clear in his instructions as Napolitano. This was a classic Essex County (Soprano country) case. A used car wholesaler was suing a used car dealer for having lied about what he got for the cars in the retail market and thus reducing his remittance to the wholesaler who had shipped him the cars on consignment. Here’s where the case turned pure Jersey... most of the cars that the wholesaler had shipped were stolen. Napolitano stopped the trial in its tracks. “Are you seriously taking up my time, the jury’s time, and this court’s time because you have been underpaid for stolen cars?”, he queried the litigant. “We wouldn’t put it that way, Judge.”, answered the lawyer. Napolitano, in the space of twenty minutes, forced the parties to settle, dismissed the jury with thanks, and instructed the bailiff to detain the litigant for a criminal investigation. Nice piece of work from where I sat.

Correction, new evidence SHOULD lead to a Hilllary Clinton indictment just like all of the old evidence but the Teflon Tyrannosaurus Rex has been there before, many times. All it will take is a few million dollars from the Clinton Foundation to the people who have succumbed to that Medusa face and she will be allowed to lie her way through congress, have Bill whisper a few words in a few ears and find a couple of lower level FBI scapegoats to indict and Presto! She´s back on the Hate America book tour. I salivate at the thought of Hussein being forced to stutter his way through a congressional hearing but I realize that´s the stuff of which dreams are made.

If Mueller and his fellow fake news sniffers were serious, they would have dropped the Trump investigation immediately and latched on to this real instance of theft, treason, corruption and the sellout of America to a foreign power by its own top leadership.

By the grace of God, and thanks to our robust and decentralized system of government, the U.S. has survived nearly a year with an unprepared, underinformed, incurious, incontinent narcissist as president. In fact, in some regards, we’ve even thrived during this past year. Still, the president’s character — mostly his colossal self-regard, his lack of self-control, and his unwillingness or inability to learn what he ought — made the year at times aggravating, terrifying, and certainly divisive.
