WASHINGTON — The Supreme Court dismissed a major challenge to President Trump´s travel ban on majority-Muslim countries Tuesday because it has been replaced by a new version, sending the controversy back to the starting block. The ruling is a victory for the Trump administration, which had asked the court to drop the case after Trump signed a proclamation Sept. 24 that replaced the temporary travel ban on six nations with a new, indefinite ban affecting eight countries. That action made the court challenge moot, the justices ruled. "We express no view on the merits," the justices said in a one-page order. The decision

I´m not sure how much a victory was achieved because it was dismissed procedurally; superseded by a new version. There was no "win" on the merits.

Of course now the opponents will have to start all over again and the lower courts had been emboldened by the lack of a conservative justice on the court which has now been rectified. The initial actions of those lower court rulings got slapped down. Maybe those judges will be more cautious and it will be harder for the plaintiffs to win, as it always should have been.

The Supreme Court should stay out of those matters as both the US Constitution and the immigration laws give the President the authority to decide which aliens should be allowed to enter the USA when national security is a legitimate factor. The thought that any of 650 federal district judges all over the country should have the power to issue restraining orders against Presidential determinations concerning national security matters is ludicrous.

A federal judge on Monday permanently blocked President Trump’s executive order to cut funding from so called “sanctuary cities.” Trump’s order would have removed some federal funds from cities that limit their cooperation with U.S. immigration authorities. U.S. District Court Judge William Orrick rejected the Trump administration’s argument that the measure only applies to a relatively small pool of money. Orrick also said that Trump cannot set fresh conditions on spending that Congress has previously approved.
