Kennedy Still in Control on Supreme
Court as Divisive Issues Loom

Bloomberg Politics, by Greg Stohr

The U.S. Supreme Court is ready to get back to normal. And that means Justice Anthony Kennedy is still in charge. The justices closed their nine-month term this week with a new list of major cases they will hear -- and without a retirement announcement from the 80-year-old Kennedy. It sets up a 2017-18 term that will have a full complement of nine justices and a group of ideologically charged cases in which Kennedy is a good bet to cast the pivotal vote. Highlights include a fight over partisan gerrymandering, a clash pitting gay rights against religious freedoms, and the

Re the travel ban, don’t forget

The case, however, could dissipate by the time the court reconvenes in October. The policy is a 90-day ban that will expire by the end of September.

That was the 90 day period - the pause - during which President Trump intended to get a proper vetting policy in place to deal with “refugees” from countries that are heavily involved in terrorism. Jihad.

It seems to me that there is something intrinsically wrong with our Supreme Court. First, the process of selection has become a political football instead of a reward for the President in office to select someone that they have previously vetted not be be an activist judge. Decisions on cases should be almost always unanimous where common sense and the Constitution is used as a template.

The judges should then send back to the Congress (legislators) rulings to make the laws for We the People. And, they should somehow be responsible to impeach and remove Circuit Court judges below them for their errant behavior and unconstitutional decisions, like the Ninth Circus wallows in. Finally, if not them, who is responsible for our life, liberty and the pursuit of happiness?

Justice Kennedy mused prior to the Obergefell SSM case about the term "millennium," about how the definition of marriage had stood for millennium, about how awesome this ancient institution was, an institution ordained by God at creation before the fall of man.

He did this not to show his humility as a mere man before God, but as a way to stroke his own ego as being equal to God, since he was planning on redefining something God had already defined for "millennium."

Everyone who refers to SSM as "the law of the land" joins Justice Kennedy in this arrogant and ultimately insane act of rebellion against their maker, and act which, absent repentance, will bring terrible consequences.

If the SCOTUS were confined to its proper Constitutional role (not the role it assumed for itself under Marbury v Madison), the opinion of an individual Justice (Kennedy or whoever) or group of Justices would not have that much "control" over the nation.

Fix the court; fix the country.

Rules need to be changed to make Supreme Court results to be determined by "super majority" and not "simple majority." And why not? It takes a super majority of States to pass a Constitutional Amendment along with the voting public, but SCOTUS can effectively pass Amendments (e.g. "Roe v. Wade") with simple majorities all the time!

It´s time this third branch of government be brought under control.

As for Kennedy, I would sooner go to jail than bake a cake for anybody against my will. My cakes are special.

The bill, which was passed unanimously by a House panel in July, would allow automakers to obtain exemptions to deploy up to 25,000 vehicles without meeting existing auto safety standards in the first year, a cap that would rise to 100,000 vehicles annually over three years. HAMPTON, Iowa — It was quitting time. Edith Rivera took one last lunch order, dropped off a basket of tortilla chips and set off from work, heading out to the farm roads where other immigrants feared to drive. Like them, Ms. Rivera, 33, had no legal status in the country where she had lived for 18 years. She had no driver’s license, apart from the long-expired North Carolina identification she held safe, like a talisman, in her wallet. Thanks to a little-noticed auction sale, a South Bay couple are the proud owners of one of the most exclusive streets in San Francisco — and they’re looking for ways to make their purchase pay. Tina Lam and Michael Cheng snatched up Presidio Terrace — the block-long, private oval street lined by 35 megamillion-dollar mansions — for $90,000 and change in a city-run auction stemming from an unpaid tax bill. They outlasted several other bidders. Now they’re looking to cash in — maybe by charging the residents of those mansions to park on their own private street.

On June 28th, President Trump convened a roundtable at the White House that included victims of crimes committed by undocumented immigrants. The event was part of the Administration’s push to pass several new immigration bills designed to, in Trump’s words, “close the dangerous loopholes exploited by criminals, gang members, drug dealers, killers, terrorists.” A regular theme of the Trump Administration’s messaging on immigration has been to present undocumented “bad hombres” as an immediate threat to the safety and cohesion of the American family unit. But some of Trump’s immigration policies, in themselves, have endangered families across America. The stories below,
