John Rivello was arrested Friday months after he allegedly sent a tweet that caused journalist Kurt Eichenwald to suffer a seizure. This arrest appears to be the first of its kind and presents serious implications for the world of internet trolling, which seeks to annoy fellow users. While I certainly don´t condone what that jerk did to Eichenwald, this is extremely concerning what impact it would have on the Internet. Why didn´t Eichenwald just avoid Twitter? I guess that´s too obvious. When will they start coming after people who make ´offensive´ comments? As insane as those on the college campuses are and the rest of those on the left that´s sure not a stretch to think of that.

Contd. The interview Eichenwald did with Tucker Carlson was bizarre, and that´s an understatement. Link below. He doesn´t seem to stable to begin with. I don´t know if that´s just who he is or if it´s part of his affliction. We will never know. But I do know that this sets a very dangerous precedent.

Twitter keeps a watch list of offensive (a subjective term) tweeters who may go too far politically, or personally, and a few have been banned. This is a unique case as far as I know, and can indeed have dangerous repercussions for the net.

Maybe the rest of you are right that this is an assault on free speech, but I don´t think sending flashing lights with the stated purpose of causing a fatal seizure are any kind of free speech.
This was designed to cause physical injury not mere insult.

I think that Kurt guy is so strange. Did it really trigger a seizure? Do they have proof?
Only 3% of the population, may have this photosensitive form of the condition, and flickering computer lights can cause it.
I have serious doubts about this.

This whole thing tears me. All over the net we see trolls, who post what they do for no other purpose than the sick joy of causing people pain. We see cyber stalkers browbeating people, making fake profiles in their names and making their lives a living hell. They have driven some to suicide.
Yet. most of us here would agree that the government should not be interfering with anyone´s speech. Here at LDot, most of us post under pseudonyms so we are not harassed in real life for our opinions. Others just lurk, and some avoid the net entirely. The truth is, to post any sort of opinion is to invite very nasty retaliation. I have a liberal friend (one of my few left) that was trolled by a supposed conservative on her twitter. The things he called her and said were so vile I wont even repeat it with euphemisms. It was totally uncalled for and the words of a coward.
So whats the answer? These animals should not do these things and there should be a penalty. Should we just wait for karma to catch up? It seems the only constitutional answer.

By itself, sending a gif through twitter (or trolling with insults) sounds like protected speech.

Sending a strobe gif with the expressed intention of causing a seizure (esp. with such a clear statement of causing severe harm as saying, "maybe it´ll make him die") should be categorized straight-up as assault.

In most cases proving intent is something only God can do. But some of these miscreants are cavalier enough in their malevolence to state, explicitly, that they hope it will cause harm. Let´s just say that such folks ought to be grateful as hell that I´m not their judge.

It has been ruled that shouting "Fire" in a crowded theater is not protected under Free Speech.

Sending a tweet intended to cause physical harm falls under the same heading, IMHO.
