Just How Confidential IS Mike Brown’s
Confidential Juvenile Record?

Legal Insurrection, by Andrew Branca

Original Article

A self-described “avid reader” of Legal Insurrection has asked us to address the issue of the confidentiality of Mike Brown’s juvenile criminal record (if any), and whether these are likely to be released to the press and public. Disclaimer: Neither I nor Legal Insurrection knows with certainty whether Mike Brown even has a juvenile criminal record, nor (if such exists) what offenses might have been charged or adjudicated in such a record. It appears that early internet claims that Brown’s juvenile record contained a serious felony were in error. The collected information released by various government actors (or refused to

They need to release the records - in full - and let the reader decide for himself.

The "official" carefully parsed words, stating that Brown was never CONVICTED of a felony.
In my state, a juvenile is NEVER "convicted", rather they are "adjudicated". The difference is zero, it´s the wording that attempts to lighten the implications.

Further, is it possible that Brown may not have been "convicted", but was he ever charged with a felony? It´s not at all uncommon to be charged but then have the charges dropped, reduced via plea bargain, etc.

The "officials" who provided the information have only served to cause more questions to be asked. The full records need to be released.

Everyone already knows that Brown was guilty of a felony: strong-arm robbery. He was caught on video.

I´m actually more interested to find out more about his parents. I´m sure his mother was a member of the PTA and his father was a Boy Scout leader. Outstanding members of the community I´m sure.

In just two weeks, Obama proven

On September 16, President Obama visited the headquarters of the Centers for Disease Control and Prevention in Atlanta. The agency is the lead organization in the federal government´s efforts to prevent the introduction and spread of the Ebola virus into the United States, and Obama used his remarks there to update Americans on those efforts. The chances of an Ebola outbreak in the United States are "extremely low," Obama said. U.S. are working with officials in Africa "to increase screening at airports so that someone with the virus doesn´t get on a plane for the United States." And then this: In the

The Two Issues That Could

Today marks the one-year anniversary for Obamacare’s health exchanges—which have helped more than 7 million people across the country enroll in health coverage. And while Obamacare’s marketplace is settling in for its second year, serious issues are cropping up that could potentially derail the entire health care law leaving millions without affordable health coverage. The first potential problem deals with funding for the law’s crucial risk corridor program, which protects insurers from major losses. Insurers who agree to sell policies on the new exchanges are compensated for if they incur heavy losses during the first few years of Obamacare’s implementation.

I must say, there’s something about the way accused White House intruder Omar Gonzalez is constantly described in the media that bothers me. I keep hearing him called “Army veteran Omar Gonzalez.” It’s true he’s an Army veteran. So I’m not disputing the fact. But I have a little trouble with the relevance. I know there is a cottage industry out there trying to hype up the threat of returning vets as the real source of domestic terrorism (we all remember the DHS-report controversy). But it’s worth noting that Gonzalez’s alleged motivation was to tell the president the atmosphere is

A large section of the Aral Sea has completely dried up for the first time in modern history, according to Nasa. Images from the US space agency’s Terra satellite released last week show that the eastern basin of the Central Asian inland sea – which stretched across Kazakhstan and Uzbekistan and was once the fourth largest in the world – was totally parched in August. Images taken in 2000 show an extensive body of water covering the same area. “This is the first time the eastern basin has completely dried in modern times,” Philip Micklin, a geographer emeritus from Western Michigan University

At least since the early part of the 20th century, aside from oil, the Arab world has produced and exported two products. It has produced essentially no technology, medicine or anything else in the world of science. It has almost no contributions to world literature, art or to intellectual development. According to the most recent United Nations Arab Human Development Reports (2003-2005), written by Arab intellectuals, Greece, with a population of 11 million, annually translates five times more books from English than the entire Arab world, population 370 million. Nor is this a new development. The total number of books translated into

Hispanic voters were a key part of the coalition that elected President Obama, but lately the demographic has soured on him. Obama’s weekly approval among Hispanics dipped to 45 percent during the period ended Sept. 28, according to Gallup, and it has remained below 50 percent for the past five weeks. While support for Obama is higher among Hispanics than the overall population, the cushion he had is diminishing as he enters the second half of his presidency. In early 2013, around the beginning of his second term, Gallup reported that Hispanic approval of Obama was 74 percent, compared with 51 percent

The Secret Service is a joke. That´s harsh, I know – and it´s unfair to Secret Service agents who unflinchingly risk their lives for the president and for their country. But it´s true, and it needs to be fixed. Here´s how. First, fire director Julia Pierson. Her agency covered up a 2011 incident in which shots were fired at the White House, when one of President Obama´s daughters could have been killed. Her agency allowed a mentally ill Iraq war veteran to rampage through the White House with a knife. Her agency permitted a security contractor with a gun and three

In educational conversation, when you mention the words “charter schools,” people tend to either love them or hate them. Unfortunately, either way, the handwriting is on the smart board. A recent survey found only 46 of 925 high-poverty New York City public schools, where most students are minorities, had even a meager 50 percent passing rate. That in itself is a big story, but the bigger story here is that of the 46 schools, 23 were charters. Of course, the United Federation of Teachers and UFT-funded parent groups are screaming foul. They say that charters can be selective in their student population by

President Barack Obama has taken a lot of flack since his Sunday night “60 Minutes” interview, in which he blamed the intelligence community for his failure to tackle the threat posed by the Islamic State of Iraq and Syria. And that is right and proper. Because not only was his excuse of blaming us a lie, but when questioned on his lie, White House press secretary Josh Earnest doubled down with a whole new lie — both of which are easily, publicly proven false. The Obama administration found itself scrambling on Tuesday to defend President Barack Obama for his lackluster 42% attendance record on daily intelligence briefings, a finding from a new report issued by the non-partisan Government Accountability Institute (GAI). Sacramento, Calif. - Gov. Jerry Brown on Tuesday signed legislation imposing the nation's first statewide ban on single-use plastic bags, driven to action by a buildup of litter and damage to aquatic ecosystems. A national coalition of plastic bag manufacturers immediately said it would seek a voter referendum to repeal the law, which is scheduled to take effect in July 2015. Under SB270, plastic bags will be phased out of large grocery stores starting next summer and convenience stores and pharmacies in 2016. The law allows grocers to charge a fee of at least 10 cents for using paper bags. State Sen. Alex Padilla, D-Los Angeles,

President Obama this week committed professional suicide. Let me explain. There is a theory in politics that once a leader has fired 50 or more people from his or her administration, he or she is finished. The reason being that by creating so many enemies ‘outside the tent’, the tent itself becomes too deluged with poisonous bile to avoid sinking into a quagmire of back-stabbing ignominy. Obama went a lot further than firing 50 people. He managed to single-handedly alienate 200,000 employees in the American intelligence agencies by going on 60 Minutes and ruthlessly chucking them all under a bus

BOSTON — Many Massachusetts households are going to see their electric bills shoot up 37 percent this winter, a rate increase that some advocates fear will put additional strain on low-income families. State regulators approved the increase for National Grid household customers that would mean an average of $33 per month more for the typical residential customer and would push a typical monthly bill higher than $150. Large-business customers will see even higher increases. National Grid has almost 1.3 million residential and business electric customers in Massachusetts. The new rates take effect in November.
