Texas Dad Acquitted in Shooting Death
of Drunken Driver Who Killed 2 Sons

A jury has acquitted a Texas father who was accused of fatally shooting the drunken driver who killed his two sons. David Barajas, 32, was pushing his broken down car along a road with his 11- and 12-year-old sons back in 2012 when Jose Banda, a drunken driver, fatally struck the two boys. Prosecutors say Barajas then shot Banda, but authorities never found the weapon or physical evidence. Barajas repeatedly cried when he heard the verdict today.

I usually believe in the law and don´t condone vigilante justice, but sometimes...I don´t know but this doesn´t bother me. I guess I´m biased as I lost my uncle to a drunk (driving) killer, but they always seem to get off pretty easy and that´s just not right. I´m glad he was acquitted.

If the dad did shoot the driver it was a crime of passion and he should never have gone to trial.

I can´t help read this and think of fat, disgusting Rosemary Lehmberg. As drunk as she was this is something she might have done. Extreme drunk drivers are a murder waiting to happen.

There was absolutely no evidence to prove he shot the guy. He may have, but there was no evidence. So, he should be acquitted.

#2, I know a man who, as a young father, got blind drunk and drove his kids into a wreck that killed all four of the children. He went to prison.

#5 I´m confused as I usually am. The blind drunk father should go to jail. He killed his kids. How does that relate to the dad in this case? He wasn´t drunk. He was in shock, he was dealing with an overwhelming emotional overload. I think everyone´s first instinct would be to lash out and attack.

Good. Now what about the Texas dad accused in the shooting death of his two teenage daughters - the muslim guy who couldn´t accept their adoption of the errant ways of American culture? I heard he´d fled the state which would make it a case for the Feds - may be the best thing he has going for him under the current administration.

My nephew was hit and thrown 80 feet by a speeding drunk driver who had his two small children in the car with him. Turned out he had been at a double bubble hour. Turns out that in Illinois Billy´s life was judged in an Illinois court of law was judged to have been worth a $500 fine and six months of arrest on work release. Billy was 15 years old. I´m happy for this father—justice was served.

One of my former classmates got drunk and drove her car down the interstate, hitting two cars killing one person, then driving on. She had a blood alcohol reading of 0.27. She got 15 years in state prison (the DA wanted 22).

She was a nice person and was absolutely devastated by what she´d done. I feel for her, but no one forced her to drink that much.

The father took care of that Texas problem. It´s probably not the first time Jose Banda drove drunk but it was his last.
Here in our state (plenty of illegals) I´m appalled at the number of drunk driver arrest and no convictions. Some have multiples until they kill someone. A drunk illegal with no drivers license killed an entire family in a van here.
I kept up with this story when it happened and knew there was no gun and not enough evidence in this case. One less drunk on the road. David Barajas now has no sons.

There is in Texas a tradition of the ´he needed killing´ defense - not in those words, exactly, but it used to be called ´temporary insanity´ - The defense attorney just wants the jury to think ´I´d have done the same thing - that guy needed killing!´

This story reminds me of a comment I read on Ferguson. Something to the effect, the police are not only there to protect the law-abiding, they´re also there to protect the criminals. Meaning the day may come when criminals miss the tender mercies of the cops, because the vigilantes are much harder on them.
