A federal judge’s "flawed" decision declaring California’s enforcement of the death penalty unconstitutional will be appealed, state Atty. Gen. Kamala D. Harris announced Thursday. Harris will ask the U.S. 9th Circuit Court of Appeals to overturn last month’s ruling by U.S. District Judge Cormac J. Carney, who said decades-long delays and uncertainty about whether inmates will be executed violated the Constitution’s ban on cruel or unusual punishment. I "respect" a politico who does their job and follows the will of the people they serve, even when against what they are defending. Second, the simple reason for the phony claim of "cruel & unusual punishment´ meme is because it takes so long to execute convicts overload courts with delays. A simple time limit, for which they have to overturn death penalty, like time to try the case and then the results. Death or life imprisonment with no chance for being let out.

The Constitution bans cruel AND unusual punishment, not cruel or unusual punishment. "And" is an important word.

Carney made the right ruling for the wrong reason. Spending decades sitting on Death Row is neither cruel nor "unusual" (in the 18th-century sense of the word).

You want cruel and unusual? These are some of the forms of punishment the Founders meant to prevent: burning at the stake, dismemberment by wild animals, and the ever-popular hanging (until nearly dead), drawing (i.e., having one´s viscera removed from one´s still-living body), and quartering (chopping the rest of one´s body into four parts).

There is nothing cruel or unusual about the work of a firing squad of sharpshooters, or about the swift, certain, and comparatively painless effect of the guillotine. Murderers, rapists, pedophiles, and traitors deserve no less.

It the problem as the judge describes it is it takes to long to execute a condemned criminal, then put in an express lane for the condemned. Problem solved and everyone is happier.

A Philadelphia Catholic high school has fired an assistant basketball coach for allegedly being connected to a recent anti-gay attack that left a gay couple with multiple injuries.
