May the government try John
Hinckley for James Brady’s murder?

The death of James Brady, President Ronald Reagan’s press secretary, at age 73 earlier this week has been ruled a homicide by a medical examiner. Brady was injured during an attempt on Reagan’s life in 1981. Let’s assume that the government can prove beyond a reasonable doubt that, but for the shooting, Brady would have lived longer (pretty much the legal test for causation in this sort of situation). Could the shooter, John Hinckley Jr., be tried for murdering Brady, even though he has already been tried for attempting to kill Brady, and found not guilty by reason of insanity? The

He is ruled mentally not responsible. Thats that. The Second Amendment doesn´t say the insane have an equal right to be armed. Though the Left will try to use that argument.

Maybe the ´logic´ is to provide Sarah Brady with a huge settlement because he died serving his country. Hinckley was already tried for his crime and found insane so will they want to find him insane again? Guess Holder does not have anything more pressing to do.

What bothers me is that Hinckley´s family want him released on a permanent basis. Even if he´s not dangerous, he´s still insane by court ruling and a life sentence at St. Elizabeth´s Psychiatric Hospital is what he should be serving. Your don´t get to shoot the President and Press Secretary and then just walk away because your family thinks that would be nice.

I never have heard of a crime tried a second time because the victim´s health changed. Is it legal? Does it mean no case ever truly closes? No statute of limitation? Don´t care about Hinckley, but if someone can do this to him they can do it to anyone.

Charging Hinckley 30 years after the fact is thinking that lacks clear definition. What did Mr. Brady die from? Perhaps heart failure? Perhaps something else. The bullet he took on that infamous afternoon may be a contributing factor do his later death, but it did not kill him. Hinckley isn´t important, clarity in the law is.

I´ll never believe that something that happened 30 years ago is the cause of someone´s death today. Regardless of the injury, our bodies change daily. No one is monitoring our diets, activities, exercise, medications (otc or prescribed), alcohol intake, etc. There may be a ´probable´ connection but there is definitely a likelihood that genetics will play a part in living to the age of 73 or older. People die at a younger age and they were not shot in the head. This is all nonsense.

He probably won´t be tried, but after hauling out a lot of arguments, this lawyer-writer, whose bio at the end of the article shows he is not a criminal law specialist, has to admit this:

So no retrial for Hinckley, despite the medical examiner’s conclusion, and even if that conclusion could be proved beyond a reasonable doubt. Or so it seems to me, based on my general knowledge of the field, and my research this afternoon; please let me know if there are some legal arguments that I’ve missed here.
