Texas installed tort reform several years ago to keep the democrat trial lawyers from stealing too much money from businesses. This guy appears to be in a league of his own. Reminds me of the guys that sued Clint Eastwood a while back over the ADA accommodations in Carmel.

Okay, truth: The ADA specifically forbids law suits for any but corrective action. No one can claim injury or pain and suffering for non-compliance. The suits can only result in judgements forcing the business or facility to correct the deficiency or to come into compliance with the act. I know this because I was an ADA compliance manager for a major corporation. Yes, a company that is not in compliance can be "sued" but it has to begin with a formal letter of complaint, bringing the deficiency to the attention of the business. In event nothing is done or a promise of future corrective action, then the matter can be brought to a civil court. But, this is an exhaustive and expensive process for anyone bringing the suit. It involves establishing proof on the part of the plaintiff that a violation actually exists. Some state have set up a compliance bureau to help mediate complaints. But, other states have chosen to establish compliance by way of their normal building code authority. New building permits all must meet the provisions of the act. Older establishments are often left to "wither on the vine" so-to-speak, waiting for renovation permits (Grandfathering them in, as it is called). This is why, for example, when you go fishing or to an out of the way gas station, you will not see ADA bathrooms or ramps or even "handicapped parking" spaces. The older establishments are specifically exempt as long as they do not ever apply for a renovation permit! Still others can simply ignore any complaints. There really is no rule that forces an existing business to spend tens or even hundreds of thousands of dollars to comply.

So, I have to wonder about this story.

#3...I hear you, but...What should be and what is are two completely different things. This sort of abuse of the legal system and the legislation goes on all the time. Some guys make their living off of this predatory litigation; there´s nothing altruistic about their motives at all. Just Google it and you´ll see. The ADA is a piece of civil rights legislation that masquerades as a building code and they know that if they whine and yell and play the victim card long enough, they´ll get what they want. It´s sick but it´s true. If people followed what the law says, Barack Hussein Obama would never have even been allowed to run for President, so that gives you some indication of how much chance the actual limitations of the law have of being followed.

When "loser pays" is enacted, all of these nuisance lawsuits go away. In the apartment business, lawsuits for $250,000 are common and settlements for $4,000 "go away" money are usually the result of the lawsuit. Our insurance company will settle the lawsuit for what it will cost in lawyer fees to defend the lawsuit.

"Loser pays" means we go to court, win, and get to collect our $4,000 legal fees from the loser.

If the man was merely pointing out difficulties in building access, that would be one thing. If he is profiting by it then I say he should be stopped. Truthfully I think it is the low class slimy greedy lawyers behind it.

On the other hand, most of you naysayers here should spend a complete day in a wheelchair and go visit numerous stores during the day, unassisted by anyone. Do NOT get out of the wheelchair except to get in and out of your car. If you were honest in completing this, you´d shut your yaps in a big hurry.

Yes I have a problem getting in and out of a few doors because of the suction that makes them hard to open. They have one at the handicap entrance at the Courthouse. I talking to the man in charge of the Courthouse with a polite suggestion. I doubt they will fix it because they don´t have to use it, which is typical of most who criticize the handicap people.
