Obama Democrats Lose Their Big
Bet on Health Exchanges

Washington Examiner, by Michael Barone

Words mean what they say. That´s the basis for the decision of the U.S. Court of Appeals for the D.C. Circuit in Halbig v. Burwell invalidating the Internal Revenue Service regulation approving subsidies for Obamacare consumers in states with federal health insurance exchanges. (Snip) Congressional Democrats and the Obama administration bet that they could force the states to do their will. When they lost their bet, the administration ignored the Constitution and ordered the spending of monies that Congress never authorized. This was lawless behavior, and reckless as well. It promised to individuals acting in reliance on government regulations money that

I want to see the twisted logic that the Obama/Reid stacked-with-loony-leftist-liberal judges comes up with to reverse this decision when the full DC circuit rules on the case.

The Halbig decision framed the question and the issue well. For that clarity we should be grateful.

But the final decisions will be made in higher courts and nothing is certain; judges sometime decide the sun rises in the West.

The thought of sitting down and engaging in good faith negotiations with House Republicans is more than the Administration can bear. Next time you hear about "obstructionist" Republicans, think of this article and smile.

Congress intended that Federally set up exchanges would be transient and will not be empowered to provide subsidies. It was a conscious and deliberate political decision. The language and the intentions are crystal clear. That the basic intention of the law is to expand health care coverage is an entirely spurious and facetious argument. Congress also intended to have a chicken in every pot. That does not give the Executive branch unlimited authority to tinker with any law they desire until it is achieved. There is low probability that the DC Circuit court will surprise us and let the panel ruling start. A higher one that the SCOTUS will, as they say, shut ´er down.

My guess is that SCOTUS will go 5-4 against the administration in a decision announced next June. This may not be a big deal, however, as there will probably be some way to weasel around the court decision.

The exceptions, illegalities, subsidies and costs of obamacare will be argued until the insane one is out of office. Then a real president will strike it down like the out-of-control monster that it is. The people still left on the hook to pay the tab don´t have enough money to finance this pipe dream. I think obama intended to borrow a few trillion more from China but that didn´t work out so he´s painted into a corner and the paint is never going to dry.

One other possible outcome is that the DC Circuit Court will rule for the plaintiffs but immediately stay the decision and give the government relief until Congress acts and fixes the wording. Which will mean that the courts will get what they want without creating a legal precedence on the separation powers and the monkey will be on the backs of the Republicans rather than the Regime. Roberts will like that.

At this point, it would take a full scale revolution to stop the ACA. Nothing - not a court, not a legislation, not even a President can stop it. Once it was let loose in the form of law, it can never be put away. It´s like ripping the engine, transmission and rear end out of your car and turning the remaining carcass into a coffee table. There really is no getting the car back to running order. Better to just go out and get a new car.

Remember this wording was put in place by the Dems before the SC ruling that the law is only legal as a tax.
The tax ruling cannot be attached to the States to collect and is only collectable from US individual tax returns.
By tying the law to a tax Roberts did handicap enforcing other provisions not explicitly spelled out in legal terms as this new ruling indicates.
If he was threatened or otherwise forced into the tax ruling he may have found a way to eventually kill the beast snowed under by it´s own deceit.

If there is one thing Chelsea Clinton is most worried about, it may be that her soon-to-be child will grow up in a world without elephants. Standing alongside her mother, Hillary Clinton, at the Clinton Global Initiative this afternoon, the very-pregnant former first daughter warned the plight of African elephants, killed for their ivory tusks, is an “existential” one, and said that if the current poaching rates continue, elephants could be few and far between within the next decade. Should Republicans make the 2014 midterms a Referendum on Amnesty? Short answer: Yes! Karl Rove would never be so impolite as to mention immigration amnesty in a Wall Street Journal op ed advising Republicans what to do. Rove, like the WSJ ed board, is a long-time amnesty booster, after all.(snip)It was voter opposition to Obama’s plan for a de-facto amnesty by executive action that caused the President to postpone the plan until after the election. Two hundred years ago on Aug. 24, the U.S. Capitol and the White House went up in flames. If not for the quick thinking of a State Department clerk, the Declaration of Independence, and many other documents dating to the founding, would have as well. On the morning of Aug. 20, 1814, Secretary of State James Monroe stood atop a bluff near Aquasco Mills, and gazed three miles south toward Benedict, a village on Maryland’s Patuxent River. Though he was without a spyglass, through squinted eyes Monroe spotted British ships coming up the river and their soldiers coming ashore. With that,
