Washington — A federal appeals court delivered a serious setback to President Barack Obama´s health care law Tuesday, potentially derailing billions of dollars in subsidies for many low- and middle-income people who bought policies. In a case before the U.S. Court of Appeals for the District of Columbia Circuit, a group of small business owners argued that the law authorizes subsidies only for people who buy insurance through markets established by the states — not by the federal government. This is the court Obama and Reid were trying to stack because they knew most judges would strike down their attempts to alter the law without going through congress.
This is why elections have consequences! We need to keep radicals off the courts before we have no Constitution left!

Inaccurate "explanation", as expected.

There was absolutely no "confusing wording in the law", which is what the AssPress uses to excuse the IRS rewriting the intent of the law by providing subsidies in states without state exchanges.

As the court pointed out, the law "unambiguously" provides subsidies ONLY in states where the state has established exchanges.
Let´s hope that the SCOTUS doesn´t do another extra-legal "salvage job" on this hideously unconstitutional law by inventing new ways to pretend it is legal.

What I don´t understand, is how they can declare just one part of the law illegal? Wouldn´t that make the whole thing illegal. It is like me saying I am just a little bit pregnant.

A third grader could have reached this decision. The language is very plainly and simply written. It is obvious that the intent of wording the law that way was to try to force states to have their own exchanges, deliberate attempt by Pelosi and company that has backfired on them.

No legal hound here but I would think that the appeals will be based on the definition of "state" and does it include the Federal government. In order for the feds to prevail I think they will have to stretch the meaning of "state" to its breaking point.

My guess is if this ruling is upheld by the SC obama will meet with Speaker Boner and a fix will passed by the House rather than using the ruling to repeal it. That along with the Republicans passing amnesty will complete our destruction. Dark days ahead.

#6 the same question asked here. Nullify one part of the communist bill would take the law off the table completely. The rats were so certain this law would stand they failed to see the flaw in their arrogance. Remember something being written in or something lacking in the law and if one portion were to be struck down the entire law would crumble.
