SAN FRANCISCO -- A federal judge declared California´s death penalty unconstitutional Wednesday, saying delays of 25 years or more in deciding appeals and carrying out occasional executions have created an arbitrary and irrational system that serves no legitimate purpose. For most of the 748 current Death Row inmates, "systemic delay has made their execution so unlikely that the death sentence carefully and deliberately imposed by the jury has been quietly transformed into one no rational jury or legislature could ever impose: life in prison, with the remote possibility of death," said U.S. District Judge Cormac Carney of Santa Ana.

Comments:
Talk about loony toons. Death sentences are rare, reserved for only the most egregious crime. Then courts - for varioius reasons - create delays, moratoriums, whatever - and then this judge says that long delays constitute cruel and unusual punishment. A mindless circle.

The judge is a Bush appointee, but this sounds like something straight out of the Obie/Holder playbook.

Yeah, because guys like me broke the system, I´m now declaring it unconstitutional. It all makes perfect sense.

The amazing thing is that I´m still going to the polls and voting. I guess I´m just stupid and haven´t come to the realization that the people´s vote doesn´t count anymore.

It really is a mindless circle. Or at least mindless.

The US courts have had over two centuries to decide this point. And what did they achieve? They started from clarity and created confusion.

Make no mistake, this endless meddling by lower federal courts is the fault of the USSC.

If a people deserve anything they deserve to know what the laws mean.

The left has turned the death penalty into a joke, they caused the slowdown now they use the slow down as an excuse to eliminate it.

The biggest problem in the Prison systems across the country today is that the worst of the worst are running the Prisons. Lifers have nothing to loose and violent control the institutions and with street gangs call the shots on the street.

I hope this judge is a victim to his folly.

Let me speak bluntly - the problem is not the death penalty but fork-tongued lawyers and a legal system that allows appeals to go on for decades. If the case was decided without flaws, as it should be, the death penalty should be carried out within 30days. Period! No delays!

The solution is to build the worlds longest gallows and hang them tomorrow morning. But no, the Courts insist on 20 years of appeals. One more aspect of the joke that our legal system has become.

St Thomas Aquinas said that to actually be a law, a law must be:
a reasonable regulation
passed by competent authority
for the common good
enforceable.

The delays imposed by the system have according to the judge have made the punishment unenforceable.

Never argue with an idiot.....they´ll only drag you down to their level and beat you with experience.
