John Boehner’s Legal Lesson
National Review Online, by Charles C. W. Cooke

‘Speaker John A. Boehner’s lawsuit against President Obama,” the New York Times confirmed yesterday evening, “will focus on changes to the health care law that Mr. Boehner says should have been left to Congress.” Thus was answered a question that has been percolating for a good month now: On what grounds will the president be taken to task? That Obamacare and not immigration is the proximate target should surprise nobody who is attuned to contemporary politics. Health reform remains a rich source of opportunity for the GOP; immigration an electric fence. But to obsess about the specifics of the assumpsit would

Let me expl;ain it to you, Mr. Cook. Boehner is looking for a way to get "standing" in court. He must pick grounds where the constitution has been violated in manners easily proven. Obamacare is full of these violaations. Obama clearly has been writing law and thus usurping the power of Congress which is the injured party and therefore has standing.

I have more contempt for Boehner than I do Obama. At least Obama believes in what he´s doing, wrong as it is. Boehner knows better and still refuses to man up and contest all the laws broken and executive orders issued. The Republicans know better and they do nothing. If they choose a candidate this time that I don´t want, I´ll not vote. I did last year for Romney but if he runs again, I won´t. The GOP better get get a grip or they will never win again.

Geez, #2, on the threads this morning, you seem to be unhappy about everyone and everything. Not I. I´m pleased about the lawsuit. It´s been carefully put together by fine legal good-guys and they have taken sufficient time to get it right. No, the legal action won´t be resolved quickly, but it will be hanging out there, plodding along and keeping Obama´s own legal bad-guys writing up responses and pleadings.

PS, #2. The suit is exactly about the illegal executive orders specific to Obamacare.

Geez #3, do you honestly believe anything will come of that law suit? Really? Obama hasn´t paid one bit of attention to anything legal. Why would he start now. And I´m pretty much a happy person, I just feel it´s okay to state how I feel about stories posted here. And I´m not happy about a lot of them.

I believe this lawsuit will fail.

There are far more people willing to go along with the Marxist communist democrats and RINO´s than conservatives are willing to believe.

As P. T. Barnum stated, ´There´s a sucker born every minute´, and the Marxist democrats have taken the best advantage of them. In this case the sucker has fallen for what can government do for you, (free stuff, money, food, housing, medical care, phones, cars, etc), and they never think or just don´t care what this attitude and has done to their families.

America is fast becoming the failure of the future as a people.

Cesspool-ites has become the norm.

The problem #6 is that many see this for what it really is; Boehner and crew avoiding doing their jobs. Boehner already has the means to stop this President and the court will refuse to take action because this is nothing more than one branch of government passing the buck to the next.

Also, everyone knows that this litigation will drag out well beyond Obama´s term as appeal after appeal are filed. By that time the lawyers will have made good coin, Obama will be gone, and Boehner and the others will have retired, become lobbyists, or will argue that continuing the suit is pointless and a waste of money because its defendant is no longer in power.

That is exactly what this "legal lesson" is about and what the unaware will learn from it.

I think Cooke was trying to say the suit will succeed if they get by the standing issue. I think they will. To get standing in fed court you need only show you are being adversely affected. When the law was first passed, it was too soon to show that. For those who think impeachmenis the answer, I recall Clinton´s where it took about two years for the house to impeach, and then the senate refused removal. And in the end it looked like a Gingrich tantrum. #3 spot on.

There is an interesting comment attached, from Madisonian, which concludes: "The only course is prudence and patience. Any conservative who cannot grasp the value of winning the senate, with this particular president in the White House, needs a lobotomy.Because it´s the only way the spectre of impeachment has any meaning or poses any real restraint on the executive.
Hard ball is thoroughly disclosed -- in whatever manifestation -- without GOP control of the senate." Nice thought, but a better one is: this is EXACTLY why the Rs will NEVER be allowed by this regime to take the Senate. Old dem motto: Whatever it takes. That used to include only political skullduggery. Now...SWAT teams, billions of rounds, FEMA KZLs....

President Barack Obama last night promised to defeat ISIS (a.k.a. Among the allies who are to conduct the ground campaign against ISIS are the Kurds (whose fighting ability is not in question), Iraqi forces that collapsed when confronted with several thousand ISIS fighters, and now the largely unknown “moderate” forces fighting the Assad regime. President Obama on Wednesday grudgingly accepted that the rise of the Islamic State of Iraq and Syria had left his preferred Middle East policy in shambles and announced a new one centered on building a broad coalition to fight the Islamist extremist group. In doing so, the president finally accepted direct U.S. intervention in Syria. Many of the actions he proposed in Wednesday night´s speech to the nation were those his administration had previously rejected as impractical over the past three years, including U.S. bombing raids and arming Syrian rebels believed to be "moderates." Rarely has a president faced a greater challenge in establishing his credibility for a new foreign-policy move than Barack Obama did in his nationally televised speech tonight. A CNN poll earlier this week found that just 30 percent of voters thought Obama had presented a clear plan for fighting the Islamic State. While Obama now pledges to ask Congress to train and aid Syrian rebels who would fight the group, voters remember that he backed similar plans in Syria in 2013, when his advisers saw Syrian president Bashar Assad as the major threat.
