Some Thoughts on Hobby Lobby
National Revew, by Yuval Levin

Original Article

Posted By:mitzi, 7/1/2014 10:06:54 AM

The general sense about the Hobby Lobby decision handed down yesterday, very much suggested by the majority opinion itself, is that the ruling is highly significant for the particular matter at hand (the fate of the HHS mandate) but of limited significance for larger and broader questions beyond. It seems to me, however, that roughly the opposite may be the case. (snip) And Justice Ginsburg’s attempt to distinguish between profit-seeking and non-profit corporations on this front, made necessary by the fact that the administration did recognize the religious-liberty claims of some corporations and not others in this case, was the

Now that the dust is settling, and people have had time to read the decision - there should be more interesting articles analyzing that decision.

If a Muslim butcher cannot be forced to sell pork, can a heterosexual photographer be allowed to refuse filming a homosexual wedding? Alito seems to say yes. Ginsburg saying yes to the Muslim no to the photographer. Kennedy seems to recommend opening a Federally run photographic service!

Canadian researchers: “Of all personality measures, sadism showed the most robust associations with trolling.” They come in all shapes, forms, manners of caps lock, and misspelled profanity, but one thing’s certain: no one likes an internet troll. Internet trolls are the thorn in the side of most people who dare to express an opinion on the internet. Trolls are the people completely disinterested in honest debate, but love to hit and run. They comment on blog posts, news articles, Facebook posts and anywhere else the internet provides a forum for their psychosis to be displayed in all its demented glory. Here

Suddenly, a spate of Republicans have come out in favor of over-the-counter contraception—putting Democrats in a tight spot politically. Making birth-control pills available without a prescription has become an unlikely midterm-election issue. Even more surprising is that the idea is mostly being pushed by Republicans. Democrats are in the unusual position of pushing back hard, insisting the move would actually limit access and breathlessly reminding voters, We´re the ones who´ve cared about women all along! The bickering over the details about how such a plan might work and whose concern for women is more sincere obscures a pretty amazing fact:

The headline might be a bit jarring, but what might be the unintended consequences of the introduction of unsearchable smartphones? Could they, say, set in motion a legal review that puts in doubt the right to abortion? The question occurs at least to us in the wake of the announcement by Apple and Google that they’ll put some smartphone data “out of reach of police and the courts,” as the Wall Street Journal put it in a dispatch on rising concern the announcement is causing among the authorities. The idea of these new systems is that once the owner of

The Canadian government has begun invalidating the passports of citizens who have left the country to join Islamic State fighters in Syria and Iraq, the National Post has revealed. Citizenship and Immigration Minister Chris Alexander said his department had also revoked the passports of several Canadians who had not yet left the country but who had intended to enlist in the militant group, the paper reported. Mr. Alexander would not disclose the number of passports that have been revoked but said there were “multiple cases.” The government says about 30 Canadians are with extremist groups in Syria and 130 are

Poll: Fewer Than One Third of Americans

Some 70% of Americans do not designate the Obama administration as friendly toward religion, according to a Pew poll released Monday. The share of Americans that sees the Obama administration as friendly toward religion took a dramatic drop to 30% from 37% in 2009. The percentage that rates the administration hostile to religion increased from 17% in 2009 to 29% in the latest poll. These findings come from a new survey by the Pew Research Center, conducted Sept. 2-9 among 2,002 U.S. adults. Some of this suspicion of Obama seems related to the administration’s perceived hostility toward religious liberty, manifested

This has been a big year for gay rights in America. In state after state, either judges or voters have affirmed the constitutionality of same-sex marriage, and public support for gay unions reached an all-time high. But there´s still a tension between the acknowledgement of gay rights and the acceptance of gayness itself. A new Pew poll on religion in public life found that exactly half of respondents said they consider "homosexual behavior" sinful, a five-percentage-point increase since May 2013. This view is most prominent among white evangelicals and black protestants; more than three-quarters of each group said they see

As NewsOK reports, about 1,600 Roman Catholics gathered Sunday afternoon to bear witness to their Christian faith, 1,200 of them crowded into the sanctuary, gym, and cafeteria at St. Francis of Assisi Church for a holy hour prayer service convened by Archbishop Paul S. A new study released Monday found that warming temperatures in Pacific Ocean waters off the coast of North America over the past century closely followed natural changes in the wind, not increases in greenhouse gases related to global warming. The study compared ocean surface temperatures from 1900 to 2012 to surface air pressure, a stand-in for wind measurements, and found a close match. "What we found was the somewhat surprising degree to which the winds can explain all the wiggles in the temperature curve," said lead author Jim Johnstone, who did the work while a climatologist at the Joint Institute

And she’s spent hundreds of thousands of dollars defending herself against accusations she orchestrated a coverup in a scandal that has come to represent everything Americans hate about the IRS. Lois Lerner is toxic — and she knows it. But she refuses to recede into anonymity or beg for forgiveness for her role in the IRS tea party-targeting scandal. “I didn’t do anything wrong,” Lerner said in her first press interview since the scandal broke 16 months ago. “I’m

Gonzalez had also drawn the attention of authorities at least twice a few weeks ago — once in Virginia, when he was found with a sniper rifle, a sawed-off shotgun, and a map with

President Barack Obama saluted a pair of United States Marines on Tuesday while holding what appeared to be a styrofoam cup in his saluting hand, a breach of military regulations that won´t win him fans among veterans and servicemen. Obama is known for drinking tea, not coffee, when he travels, especially before delivering speeches. His quasi-saluting gesture was an instant embarrassment for the White House, and not because his environmentally taboo drinkware clashed with the green-policy speech he was on his way to deliver at a UN Climate Summit. The United Nations Climate Summit will begin in New York this Tuesday, but environmental activists didn’t wait. All day Sunday, they filled the streets of Manhattan for a march that featured Al Gore, New York City mayor Bill de Blasio, and various Hollywood actors. But they certainly didn’t act like a movement that was winning. There was a tone of fatalism in the comments of many with whom I spoke; they despair that the kind of radical change they advocate probably won’t result from the normal democratic process. It’s no surprise then that the rhetoric of climate-change activists has become increasingly

He was a leading figure in one of the biggest climate change marches to date. But it seems Robert F Kennedy Jr was not so forthcoming when it came to questions about his own carbon footprint. Confronted by a reporter asking if he would give up his phone and car, the environmental lawyer became visibly irate before grabbing the microphone and accusing her of ´destroying democracy´ as a member of the press. The interview in New York yesterday afternoon started with a conversation about the number of flyers produced for the event, which Kennedy Jr claimed was necessary to garner ´people power´.

Clinton’s relationship with Alinsky, and her support for his philosophy, continued for several years after she entered Yale law school in 1969, two letters obtained by the Washington Free Beacon show. The former Internal Revenue Service official referenced the infamous cannibalistic serial killer as she broke her silence for the first time about last year’s IRS scandal.
