Newark - A New Jersey man named Clinton Tucker is suing former employer Benjamin Moore, claiming discrimination regarding the paint company´s colors "clinton brown" and "tucker chocolate." Tucker, who identifies himself as an African-American man in the lawsuit filed in Essex County court in Newark, said he was hired in June 2011 in the digital marketing department but quickly found himself being discriminated against, according to a write-up of the filing on CourthouseNews.com. In the actual filing, he identifies himself as a "homosexual African American man." I´m not sure why he felt it necessary to add his sexual orientation.

If the names "tucker chocolate" and "clinton brown" have any traditional or historical significance, there is no case.

So if his name had not been "Clinton Tucker", can we assume he never would have brought this suit?

Benjamin Moore has colors such as "seminole brown", "navajo white" (2013 color of the year), and "white chocolate." Will we see a lawsuit brought by the Seminole and Navajo nations next?

One other thing, bukco! Everyone knows that Robin Hood´s merry man, or gay man if you will, Friar Tuck, constantly wore a chocolate colored robe as was the custom of all Monks back then.

It is a matter of recorded history that he was "affectionately" known as Tucker by the other men("come into the woods with me, Tucker!"). They are clearly honoring Friar Tuck with the flavor Tucker Chocolate, not making fun of a gay black man of the same name.

The St. George TUCKER House is one of the most historically recognized homes in Williamsburg VA. It dates from 1716 and is now situated on Market Square and serves as a reception gathering place for Colonial Williamsburg donors.

All the colors in the BM Williamsburg paint collection have historical significant names in the Williams rug. Immunity. I do not know what honor the Clinton name is for, but will try to look it up. Tucker paints are definitely named for colors used historically in Tucker House, not for Friar Tuck or any frivolous reason, #8.

Just a little more BM info. The Tucker color is one of their Williamsburg Collection, approved. Y the Colonial Williamsburg Foundation, and definitely historically based as all the Williamsburg Collection is.

The Clinton Brown is not a Williamsburg color , just another color name in the regular BM line of paints.

This guy is nuts and his lawsuit will be thrown out before it´s ever heard.

This is outrageous. I see a class action suit coming up. Anyone named Tucker, or Clinton, or Brown, or Chocolate, should be represented in the suit. If they win, as they should, they will be entitled to a small can of Tucker Chocolate paint at half price. The gallant defenders of their rights can divide up the remaining millions among themselves.

I hope the employer has a copy of the Employee Handbook as it stood when he was employed, along with copious notes of when and how he violated items in that handbook. Simply asking his co-workers (or checking the copious notes) would reveal who instigated the conditions that constituted the "hostile workplace" that doesn´t happen in a vacuum, as well as the "demotion," could it be that he foisted his personal proclivities (which should have been relegated to personal hours) upon coworkers, making them feel "uncomfortable" enough to complain to HR?

These days, after decades of frivolous "wrongful termination" and "hostile workplace" individual and class action lawsuits, most large employers have every conceivable situation covered in their handbooks, and written procedures for handling "disgruntled" employees.

This is reminiscent of the color Crayola used to have that was called "Indian Red." Never mind that it was named for a dye color widely used in India. The Crayola people got so scared of being sued or even bad-mouthed by American tribes that they discontinued the color. They could have called it Bombay Red or something similar, but they just deep-sixed it.
People are too darned sensitive!

In an attempt to fire back at House Speaker John Boehner concerning the release of Sgt. Bowe Bergdahl, Rep. Jackie Speier (D-Calif.) went on MSNBC Tuesday morning and had an interesting view of the Taliban, disputing that they are terrorists. Earlier, Boehner held a news conference and was critical of the fact that Congress wasn´t fully briefed on the exchange.
