In the absence of a special prosecutor, the best opportunity for piercing the veil of secrecy and evasion that surrounds the IRS handling of groups perceived as enemies of the Obama administration lies in civil litigation. Now this is intriguing. "Spoliation" is something I heard about for the first time when Trey Gowdy asked Koskinen if he knew what spoliation was? He didn´t. We can add that word to our lexicon of words we may be hearing a lot of in the coming days.

The potential destruction of evidence, by becoming a separate tort, opens the door for judicial inquiry into the IRS destruction of evidence. Armed with subpoenas and able to examine and cross examine people under oath, Z-Street has the potential to bust open what really went on at the IRS.

So if the front door won´t work in the present Lois Lerner IRS situation, let the Z-street case bring us in the side door. If it´s good for Democrats to sneak in the back doors, we can play that game, too.

Here´s hoping and praying someone, no matter their motivation, will blow the IRS´ and Lerner´s stonewalling to kingdom come.

Interesting article and case. We need about a dozen more tort trials like this one to peel away the egregious layers of lies. And I agree that civil cases (as opposed to criminal ones that depend on Holder´s InJustice Department) are the best path to justice here.

The federal judges in the civil suits must be pressed by the plaintiffs to appoint special masters to investigate the IRS´s handling of evidence covered by the rulings already made by the federal judges. The federal judges in the civil suits are the only hope of getting behind the Obama thugocracy´s stonewall.

The MSM is in full agreement with the Obama administration to cover up all proof and allegations of doing anything illegal. The IRS has already destroyed or think they have destroyed any and all proof of illegal activity.

If there is not a Special Prosecutor appointed there will never be any criminal charges brought against anyone in or out of the Obama administration or the bureaucracy full of dedicated criminal communists just like their leader Obama.

Paying fines with taxpayer dollars is not punishment that will put an end to these communists in government. The only remedy for this is jail time and loss of any and all government benefits.

This is an extremely interesting article that ties to Trey Gowdy´s accusing the IRS of spoliation - willful destruction of evidence - which is a crime in itself.

I am glad to see Gretchen Carlson get some credit. Her program is often very interesting, and she is neither a cutesy airhead nor a strident ranter. She does a great job of getting into issues and current events that others - even at Fox - seem to miss.

#9, while all of us agree that this is indeed a case worthy of criminal prosecution, the fact is that Holder will not allow that to happen. And so pursuit of civil tort is the best strategy here. And that is precisely the point of this article.

Unlike the congressional investigations, such civil cases would allow the attorney for the plaintiffs to invoke discovery proceedings, which are lengthy, detailed questioning sessions that are likely to both uncover critical details and also trip up the lying defendants.

Go for the civil cases. Flush them out and sue the heck out of them.

Isn´t it interesting that the biggest whiners about being discriminated against (Blacks), are the worst Nazis when they obtain power. Thanks to the Pro-Israel group for bringing this to light. An ethnic group that were incinerated in ovens by the millions by another Nazi group.

The great thing is exactly as the article says, that the discovery process will expose information that will lead to other legal actions, including criminal ones. Even if the IRS decides to stonewall they can be held accountable and possibly other groups can go after them as well.

I´ll bet they find quite a bit more than a smidgen of corruption. Of course the trail to the White House might have been eradicated so the IRS could take the hit for its actions without directly implicating BO. That would be disappointing but it would further prove that BO´s leadership is inept and the people under him are corrupt.

Of course it is possible that some of those emails do surface from some other source. That would be delicious. Proven conspiracy to hide a criminal act. I would love to see Lerner in a prison outfit.

Sounds somewhat familiar to the O.J. case. He was found "innocent" in his criminal trial but was found guilty as he** in his civil trial. And in a civil trial, the rules for guilty are somewhat weaker than in a criminal trial(prepondence of evidence vs beyond a doubt). What we are hoping for here is for the TRUTH to oome out and be presented to the public. And leading to some criminal trials and convictions wouldn´t hurt either. Now, we just pray that the attorneys for Z-Street will press the case post haste. The faster, the better.

Holder does not care about this. They will let this case move forward and the IRS take the blame as incompetent and not complying with the regulation to keep all email. They will even pay the damages. The IRS comes off with another black eye. Big Deal, what else is new. Meantime, Lerner, Obama get away with it. The main goal of Holder is to protect Obama from fallout of being involved. If the IRS goes broke paying damages and Obama is never associated, them mission accomplished.

However, here´s the thing about civil cases: Many of them settle before much is accomplished. I hope these plaintiffs have the staying power and resources not to cave for a meaningless, taxpayer-funded settlement payoff.

#1, I immediately thought of Gowdy talking about spoliation of evidence, too.

Another point that I have not seen mentioned in many places is that Lois Lerner´s message suggesting possibility of auditing Senator Grassley was marked that it was sent from her Blackberry. There are a lot more places to subpeona, including her Blackberry account.
