President’s Recess-Appointment
Power Cut by U.S. Supreme Court

Bloomberg, by Greg Stohr & Laurie Asseo

Original Article

Posted By:KarenJ1, 6/26/2014 10:12:30 AM

The U.S. Supreme Court curbed the president’s power to make temporary appointments without Senate approval, backing congressional Republicans and dealing a blow to President Barack Obama. The justices ruled unanimously that Obama exceeded his constitutional authority when he appointed three members of the National Labor Relations Board in January 2012. Four justices would have gone further in limiting the appointment power.

Comments:
Wow! A unanimous decision! Now if we get a favorable ruling on the Hobby Lobby case it will be a good day for us. This is the entire article.

I forgot to add that Jay Sekulow was just on Fox and said this invalidates the appointment. So how does that impact the outrageous rulings by the NLRB. Are they all now invalid? It´s a great ruling, but chaos will ensue.

My thoughts, too #3. I want to know what particular remedies go along with this ruling. I don´t believe the courts have the power of impeachment. John Boehner and the House does. But will the current Senate convict and remove? Who has the authority to invalidate the NLRB rulings?

Oh, what a tangled web for them. For us, nothing will really change.

Yes, #3: in this sad political environment, even "good" things aren´t really all that good.

#3 - Exactly. Chaos is the Øbamboozler´s stock-in-trade and to him it simply does not matter how he achieves it. In other words, he probably considered the fact that if the appointment is invalidated, so could subsequent rulings, but you see he simply does not care. Chaos is chaos no matter how it manifests itself.

Republicans on the Hill cheered the 9-0 Supreme Court decision that found President Obama’s January 2012 appointments to the National Labor Relations Board were unconstitutional, while the top Democrat in the Senate maintained that the White House was in the right. Obama branded them “recess appointments,” but the Senate was actually in pro-forma session at the time. In September of that year, 41 GOP senators filed an amicus brief in support of the case brought against the presidential appointments. The U.S. Court of Appeals for the District of Columbia ruled the appointments of Sharon Block and Richard Griffin were unconstitutional

You´d think someone who had thrown 85,000 people out of work, as this former Enron task force chief prosecutor did in her indictment of Arthur Andersen, before the whole thing was thrown out by a 9-0 Supreme Court, would go quietly from the public spotlight. Not so with Caldwell, a notoriously anti-business activist who in concert with the Obama White House is instead failing upward.

Charles Krauthammer sat down with Greta Van Susteren tonight to react to the Supreme Court decision limiting President Obama‘s power of recess appointments. Krauthammer said Obama knows he’s “beyond the bounds” of the office, but at this point he feels he can “abuse the Constitution” if he needs to. The 9-0 decision, he said, was a “major rebuke” to Obama which stated nothing more than if the Senate says it’s not in recess, it’s not in recess. And the fact the Supreme Court ruled this way suggests to Krauthammer that John Boehner‘s lawsuit against the president over executive actions “might

The Supreme Court this week admonished the Environmental Protection Agency for overreaching in regulating greenhouse gases. The Clean Air Act covers polluters that emit 250 tons per year (or in some cases, 100 tons). This standard makes no sense if applied to greenhouse gases. Thousands of establishments from elementary schools to grocery stores would be, absurdly, covered. So the EPA arbitrarily chose 100,000 tons as the carbon dioxide threshold. That´s not "tailoring," ruled the Supreme Court. That´s rewriting. Under our Constitution, "an agency has no power to ´tailor´ legislation to bureaucratic policy goals by

With Cochran forced into a runoff fight against an aggressive and energetic challenger, a dark mood shadowed his backers in Washington and Mississippi.Yet almost immediately, the Cochran coalition began bouncing back. Over several months, the party has expanded its range of targeted seats, and the National Republican Senatorial Committee (NRSC) has helped defeat insurgents it didn’t want representing the GOP in the midterm elections. National conservative groups are angry after incumbent Mississippi Sen. Thad Cochran pulled off a victory in the state’s GOP run-off — likely because of his campaign’s outreach to Democratic voters. “It’s disgraceful that self-described GOP leaders like Mitch McConnell, John McCain, the Chamber of Commerce and the NRSC would champion a campaign platform of pork barrel spending and insider deal-making, while recruiting Democrats to show up at the polls,” Matt Kibbe of FreedomWorks said after the results came in. Tuesday’s closely-watched run-off came after conservative state Sen. Chris McDaniel edged Cochran in votes in the initial election earlier this month.
