I had a column on the home-page yesterday about a practical step congressional Republicans could take to combat the rampant presidential lawlessness I’ve documented in Faithless Execution—to wit, they can start impeaching subordinate executive branch officials who have been involved in either (or both) the IRS abuse of Americans over their political beliefs or the cover-up of that constitutional affront, which has involved misleading testimony, destruction of evidence, and obstruction of justice. On Sunday Kevin McCarthy spewed some silliness about closing the border...just what the Grassroots Conservatives want to hear.

Today John Boehner spews some more silliness about suing the President. Maybe some day the Republican Party will grow a pair and do their constitutional duty or just forget it. This is all happy talk that will lead to nothing. There is not enough time to sue the President because it will never see a court room.

So whose legal assistance did Boehner have when writing this memo? There are plenty of learned attorneys around, the author of this article being one, Mark Levin another. If Boehner is going to do this, he might as well do it right. This is simply lip service, hoping this memo will keep everyone quiet. He´s out as majority leader.

The absolute frustrating thing about Boehner is his unwillingness to use the House´s power over spending. There is no benefit of controlling the House, or having Boehner as Speaker. He refuses to use his power and may as well be a back bencher.

Nor can you continue to nominate flawed candidates who lose elections via their big mouths while pretending to be real Tea Party conservatives.

Surprisingly, Mark Levin wasn´t nearly as hard on Boehner as McCarthy, who I very much respect. He doesn´t have a problem with this lawsuit, even though he has pointed out what I and many others of you have said, that Obama will be long gone before it winds its way through the courts. He still pushes for control of the purse, that´s where you get them.

This is nothing but a stunt by Boehner to try to act tough and to draw attention away from the shenanigans the Republican Establishment pulled to get Cochran elected.

Boehner knows that even if he was seriuos this would be tied up in the courts for years.

Only the truly soft beleaves Boehner is serious.

ALAN COLMES: You know it’s funny to me that conservatives talk about how much they love the constitution but when somebody exercises their constitutional rights they’re declared guilty when they’re not supposed to be. Simply because of the Fifth Amendment. Does invoking the Fifth Amendment indicate guilt? I mean, I love how conservatives always tell me how much they love and admire and basically want to have sex with the constitution – except they’d probably get paper cuts with that old parchment paper – but when somebody actually exercises their constitutional rights, it’s a big problem.
