A woman who parked her car on a highway to rescue ducklings has been found guilty of causing the deaths of a motorcyclist and his daughter who slammed into her vehicle. Emma Czornobaj was convicted by a jury on Friday on two counts of criminal negligence causing death, a charge that carries a maximum life sentence, and two counts of dangerous driving causing death, which comes with a maximum of 14 years in jail. This is ridiculous. Every day I encounter UPS trucks, buses, cabs, and other vehicles that just park in traffic. This woman didn´t intentionally cause this accident. When you are driving you have to watch what is in front.

She lacked common sense and now she needs to put her big girl pants on and face the consequences. I hope sympathies will rest solely where they belong - to the families of the deceased victims.

Canada has the same road rules as the US, the left lane is for faster traffic, not for parking. Those UPS trucks, etc listed by OP are usually in the far right lane, if not by the curb.

I have the opposite reaction from OP. It is illegal to stop/stand/park on a highway- in New York, anyway - for crying out loud, people are driving at high speed. She stopped in the left lane, the passing lane. She´s an idiot.

Not so long ago, we were travelling on a highway, in the left lane, and found ourselves getting very close very fast to the car in front of us -- turns out it was stopped because the driver had missed the exit and so he literally stopped, in the left lane, to wait till he could make a right, so to speak, and take the exit. It was frightening as hell because of the speed with which we came upon him and we barely had time to stop.

Don´t put me on that jury. Rear end collisions are usually the fault of the driver in the rear, without question. People need to look beyond the hood of their car, or in this case the wheel of the motorcycle. It was a horrible accident, caused by poor judgement by the woman and a lack of attention by the man. Definitely not a life sentence and since when did negligence equate with 1st degree murder?

Under centuries old English jurisprudence severe sentences such as capital punishment or life are given for INTENTIONS. She needs to be punished for stupidity but the sentence is stupider. That is the point. And when the law is stupid someone pays unfairly with their lives.

Both at fault but to what degree?

Motorcycles are already a few percentage points behind. And as stated above that risk is accepted when you climb on. Doubled with a passenger.

I feel sorry for all involved, but yes this young lady showed poor judgement. The most important driving lesson I learned from my dad was to not feel sorry for animals in the road and cause an accident. Not long after that I was driving on a rural road with almost no traffic, undoubtedly driving over 65 mph (back before federal speed laws went into effect). A mother duck was crossing the road with her dozen or so ducklings all in a row. I could not slow down fast enough to avoid them and hit the very last duckling. A horrible feeling, but since then I´ve had worse experiences with animals in the road. I have been so grateful for those wise words from a dad who knew where my heart was and wanted to prevent an accident like this one.

Wasn´t your daughter was it Cat. Yep no way was it on a blind curve, I´m always able to shut it down from 65 mph to zero when the driver in front of me decides to stop, even though now one else is stopped and I have no warning and I can´t see them until I´m right there, etc. etc.

My son´s car broke down while he was in the left lane of heavy traffic. By grace and by the awareness of other drivers, there were no accidents. You have to be prepared to stop anytime, anywhere. The woman was very, very stupid but the sentence is too harsh.

The headline is just a "shock value eye grabber" IMO. Josh Brent faced 25 to life and got 6 months.

A similar accident happened two years ago on the I-10 Atchafalaya Bridge (~20 miles long) when Louisiana State Police stopped traffic to help rescue a stray dog on the bridge. An 18-wheeler wreck and killed a motorcyclist, the only person charge was the 18-wheeler trucker, not the Louisiana State Trooper.

Throw her in jail. She sounds like a liberal who puts ducks above humans. I was almost killed the same way. A truck stopped on the freeway because of a dog, which stepped out from the stopped truck into the lane where I was traveling at 60 mph on my motorcycle. It was a miracle when I hit the dog that I maintained control. If I hadn´t been in such shock I would have killed that truck driver on the spot. You never, ever stop your vehicle in a travel lane except at a controlled intersection.

This sounds like a case of involuntary manslaughter committed through an act of reckless conduct with an automobile. The punishment should fit the crime. I doubt Ms. Czornobaj will get life, but she should do some serious time to pay for her stupidity and the lives of her victims.

Prosecutor Annie-Claude Chasse had a message for motorists. ´What we hope is that a clear message is sent to society that we do not stop on the highway for animals. It´s not worth it,´ she said.
Czornobaj left the courthouse without commenting.
According to National Post, she is a financial analyst who graduated from Concordia’s John Molson School of Business where she made the dean’s list."


Success in school does not fix stupid. Emma Czornobaj must be held responsible for the poor judgment that cost Pauline Volikakis her family.

She certainly shouldn´t have stopped on a highway, especially the left lane.

Recently, I slowed down (on a road where the speed limit was 30 mph, just before a sharp curve where it is reduced to 20 mph) because there were several very large Canada Geese walking in the road, along with some of their chicks. The guy behind me, going much faster than the speed limit and gaining fast, nearly rear-ended me, even though my car was still moving, just slowing so as not to hit the very large geese. Doesn´t anyone pay attention to brake lights, or road conditions, anymore?

People are stupid. Just last week a lady panicked and stopped on the freeway when a bus was merging on next to her. Both her and the bus were stopped in front of me. I couldn´t go around her due to traffic and the guy behind me had to go off to the side of me to avoid rear ending me. Nobody got crunched and the lady finally started moving again, unaware she could have died. Regardless of the reason for this gals stopping it was on me to not hit her.

Those who drive freeways know that to stop abruptly in the left (fast) lane is more dangerous than to stop at speed.

There is no comparison between this and a delivery truck double-parked on a city street. Where I live they have their flashers going and downtown speeds are 25mph.

The lawyer doesn´t seem to get this:

´This was not a race. This was not a person who took a chance and drove drunk. This is not about someone who was speeding and took a risky maneuver.´

As for her sentence, she "faces" those sentences. It is unlikely that she will get more than a few years and probation.

She KILLED two people as surely as if she had run into them.

Maybe someone brighter than I can tell me how watching in front would have prevented the motorcyclist and his passenger from hitting a car that slammed on the brakes in front of them to keep from hitting ducklings? On many freeways, where the speed limit is 65mph and many are going faster, it is physically impossible to get a motor vehicle of any kind to cope with this kind of foolishness. There usually isn´t time for diversionary action either, nor is there always a place one could swerve to avoid collision.

I think we have a few non-freeway drivers here!

With that "standard" responsibility rule (that the driver who hits another car from the rear is at fault) all bets are off if the car in front slams on its brakes.

Common sense tells us that as soon as this woman saw the ducklings in front of her she stopped quickly. In the left lane she had to be already going the speed limit or probably more.

The motorcyclists would not have expected that, even if they were looking far down the road ahead.
