Justina Pelletier, the Connecticut teen who was essentially taken hostage by the Boston Children´s Hospital 16 months ago, was finally allowed to return home to her family Wednesday, and her father has vowed to pursue legal action against the Massachusetts authorities responsible for the injustice. This is heartbreaking and horrifying what happened to this young girl. She used to be active she is now confined to a wheelchair because of their abuse. For the authorities to essentially kidnap her when she went for a second opinion as recommended by her doctors, is behavior you only see in tyrannical regimes. Welcome to the new America. I would also add, if we didn´t have an Attorney General that was corrupt and lawless, this cries out for an investigation. I have read this is not the first time this type of situation has happened with that hospital. The questionable circumstances of her kidnapping be ignored! This was pure and simple child abuse!

Praise the Lord for his mercies, common sense has prevailed. The scandalous part is that after 15 months in custodial care an active teen, enjoying ice skating and normal teenage activities, has been turned into a virtual paraplegic . This is gross negligence and medical malpractice at its most egregious. I rejoice with the Pelletier family that their youngest lamb has been returned to the loving safety of her family.

There ought to be jail time for false imprisonment, interference with parental custody, etc., and huge personal damage payments from the individuals who perpetrated this travesty. Action ought to extend to medical malpractice for the doctors involved.

From the United Mitochondrial Disease Foundation, here is what the parents contend that she has:

Mitochondrial diseases result from failures of the mitochondria, specialized compartments present in every cell of the body except red blood cells. Mitochondria are responsible for creating more than 90% of the energy needed by the body to sustain life and support growth. When they fail, less and less energy is generated within the cell. Cell injury and even cell death follow. If this process is repeated throughout the body, whole systems begin to fail, and the life of the person in whom this is happening is severely compromised. The disease primarily affects children, but adult onset is becoming more and more common.

Diseases of the mitochondria appear to cause the most damage to cells of the brain, heart, liver, skeletal muscles, kidney and the endocrine and respiratory systems.

Depending on which cells are affected, symptoms may include loss of motor control, muscle weakness and pain, gastro-intestinal disorders and swallowing difficulties, poor growth, cardiac disease, liver disease, diabetes, respiratory complications, seizures, visual/hearing problems, lactic acidosis, developmental delays and susceptibility to infection.

Regardless of our feelings about her being kept away from her parents, it seems to me that it will be difficult to prove that her present condition is a result of medical negligence.

About Justina´s ice skating and being OK before she went to the hospital, this article tells a different story. It begins with the night her mother rode with her in the ambulance to the hospital:

They were making the white-knuckled trip from Connecticut because 14-year-old Justina wasn’t eating and was having trouble walking. Just six weeks earlier, the girl had drawn applause at a holiday ice-skating show near her home in West Hartford, performing spins, spirals, and waltz jumps.

But now Justina’s speech was slurred, and she was having so much trouble swallowing that her mother was worried her daughter might choke to death.

When the ambulance finally made it to Longwood Avenue and pulled into the driveway of one of the nation’s top pediatric hospitals, the mother thought, “I’m saved.” Her relief wouldn’t last long.

Justina had been sick on and off for several years. A team of respected doctors at Tufts Medical Center in Boston had been treating her for mitochondrial disease, a group of rare genetic disorders that affect how cells produce energy, often causing problems with the gut, brain, muscles and heart.

So, she had been ice skating, but then she became very ill, very debilitated. And then she was taken to the hospital.

Perhaps the family is owed something for her being kept in the hospital against their wishes, but she was probably receiving medical care all along for her mitochondrial disease. They´ll have a hard time proving that her present condition was caused by the hospital as they seem to be contending.

Will they become consumed with this legal battle rather than enjoying and nurturing the daughter they missed so much?

There is NOTHING that condones the mistreatment of these people. They kept her away from her family, her church, everything that would give her comfort!

She was a prisoner!
I hope they all go to jail for what they have stolen from this family!

I´m sorry #5 but under no circumstances was her imprisonment in the hospital okay. She may have been sick, but her parents have the right to have her treated wherever they darn well please. And at 14 years old, she has a right to have a say in her own treatment. Amazing how the right of 14 year old to obtain an abortion is celebrated and protected in this county but a 14 year old begging to be released to the care of her loving parents is given no rights.

#5, the doctors at the Mass hospital did NOT treat Justina for her mitochondrial disease. They said her illness was all "in her head" and that her parents were abusing her because they didn´t agree with the Mass doctors´ diagnosis. And these out-of-control Mass doctors got the court to limit parental visits to 1 hour a week with someone from the government watching. Justina could not have any visits from her priest, not even at Easter or Christmas. These tyrannical doctors and the despotic Mass state government held this young girl hostage and if she died, she died - what happened to this family is despicable and I hope the Pelletier family sues that hospital, her doctors and every government agency into the ground.

WHAT is poster # 4 smoking? Doctors at well regarded hospitals in Connecticut have made and affirmed the diagnosis, and the Dr. to whom she was sent for a 2nd opinion in Mass. has also concurred! What does #4 know that none of them do? Outrageous!

I think posters 4 and 5 are missing the point---though it is also true that any medical treatment was forestalled for 15 months while she was treated for some ER dr´s assessment (after 25 minutes) of a psychological disorder. The POINT is that she was taken from her family and her treating physicians and held by the state of Mass. for 15 months! The State ignored all and TOOK her!

#5 and #4 - the problem with the imprisonment of Justina is that she was not treated for her mitochondrial disease. A Boston Children´s Hospital doctor diagnosed her, nearly instantly upon her arrival, with "somatoform" disease, basically, that her illness was all in her head. (This just happened to be that doctor´s pet disease that he is working on.)

In the roughly 16 months the child was held hostage by Boston Children´s Hospital and the State of Massachusetts, she lived for much of that time in a locked psych ward at the hospital. She received little medical care (remember, her disease is all in her head) and no schooling. In addition, her parents were permitted only a short supervised visit with her each week.

If that is not grounds for a massive suit against BCS, and the State of Massachusetts, I don´t know what is.

Thank you # 16. That is exactly what I was going to say. The state of Massachusetts did not treat her for the disease that she was originally diagnosed to have. They virtually did nothing. Also how can the state of Massachusetts seize a resident of another state? She was a resident of Connecticut.
