If the president wants to witness a refutation of his assertion that the survival of the Affordable Care Act is assured, come Thursday he should stroll the 13 blocks from his office to the nation’s second-most important court, the D.C. Circuit Court of Appeals. There he can hear an argument involving yet another constitutional provision that evidently has escaped his notice. It is the origination clause, which says: “All bills for raising reveornue shall originate in the House of Representatives; but the Senate may propose or concur with amendments as on other bills.” The ACA passed the Senate on a

The ACA is clearly unconstitutional because it originated in the Senate. Any 12th grade civics student could figure that one out. But we have lawmakers and justices like John Roberts who are experts not in the law, but in sophistry. Some unintelligible rationale for why it is ok will be distilled from thin air, and we will remain in this tar pit forever.

The Constitution is the law of the land. Will is relying on provisions of the Constitution to be followed by people who use the Constitution for toilet paper.

George, holding up the Origination Clause of the Constitution is like putting a sign outside a business, No Guns Allowed.

Roberts was playing the long game. He also was hoping that the citizens of this once great nation would throw off its shackles and rid itself of the Obamanation - and spare the SCOTUS of having to dirty itself in a political barroom brawl. Just think how much howling there was when the SCOTUS decided in favor of Bush during the 2000 election. Now imagine that howling multiplied by 1000.

However, our nation voted stupidly and thus it continued to wander down the road to serfdom. So now finally it is time for the SCOTUS to do what it Roberts hoped it would be able to avoid doing - eradicating the infamous thing known as the ACA - by using judges rather than the much more preferable voters.

The Supreme Court overturned a ruling of the DC District Appeals Court on the EPAs power to rewrite the Clean Air Act so that the EPA could assign pollution reductions based not on what the state emitted but on how cheaply they could remove a ton of pollution. The dissent featured the argument that this was very much from each according to his means to each according to his needs. Democrats don´t follow rules, they don´t need no stinking Constitution.

I think the importance of Roberts is that he ruled the Obamacare mandate was a tax, and thus allowable. It is his ruling that sets in motion the current judicial challenge. If it is a tax, then Constitutionally it needs to originate in the House chamber. It would be a delightful irony if it is Robert´s that ultimately brings Obamacare down.

Must read.

Just think how catastrophic this could be for the Dems. They should get crushed this November, especially if insurance rates increase a lot (which they will).

So, Obamacare turns into a totally Pyrrhic victory.

Then it´s overturned by Roberts -- the same stickler for details that ruled it´s a tax. (which it is. It´s gonna be on your tax return, and it sure as hell won´t be a deduction.)

#6 nailed it. Roberts is playing the long game and, at this point, he looks absolutely brilliant.

Oh, and one last point. The big news in November will be the Republicans taking over state governments. Then they´ll pass voter ID and the dead will stop voting. The Dems will never recover. In the long run, this will be most significant.

Why didn´t CJ Roberts do the right thing and rule against the ACA the first time it came before the court? Why change the answer on the test paper for the democrats? It makes no sense. It is not like the democrats would have stopped pushing the ACA. They would have fought tooth and nail to retool it, but the one thing the Roberts Court could have done by upholdering the Constitution is prevented the damage that has been done now to all Americans. It seems we have come full circle and I don´t hold out hope that the Roberts Court will rule against Obamacare this time either. Follow the law according to the Constitution and forget the politics of it. This, of course, should have been the basis for any decision all along.

It should and must be tossed based on the will of the people - - expressed through the representatives they elect. Not wanting his court --- the Roberts Court --- to be mericlessly Palinized by the Left and hence the culture at large, Roberts gave into the thinly veiled bullying emanating from the regime and concocted his novel and risible ruling. IMO it is not merely ironical that Roberts´ ruling that the mandate is a tax will be the death of the ACA. I have always felt that this is precisely what Roberts had in mind. The majority will simply rule that the law be reintroduced and passed from the House to be Constitutional. That way the SCOTUS is not blamed for overturning ´the will of the people´ and it will give us the ´14 election where the ´Rats who still don´t get it, continue to fall on their collective swords.

I´m sorry, but there is zero possibility that Roberts set this up as a tax issue in order to knock it down later. Reason? That very argument could have and should have been used in the original case to kill the bill outright.

If it´s a tax, it must originate in the House. It didn´t, so it´s unconstitutional. That was known then. They could have killed it. They didn´t. And they won´t this time either.

We have a totally politicized Supreme Court, with the Three Twisted Sisters ruling solely on liberal ideology and not the law, three genuine jurists (Scalia, Alito, and Thomas), two jello jurists, and a hair-splitting, set-up-for-extortion Chief Justice. I have zero faith that they are capable of protecting the constitution.

The only part of the Bill that originated in the house was it´s number. The court will use this technicality to uphold the law, because they feel it is a matter for the people, the House.

Most people don´t know how the Bill was passed. Perhaps if there is enough coverage of this aspect of the Affordable Care Act, people already stressed by the new laws will force their Representatives into action.

It seems John Boehner has finally had enough over Benghazi and the IRS. Perhaps push back will become a habit in the House. We can only hope...dudes.

Hopefully Chief Justice Roberts will document and report the extortion to the FBI this time so he can rule properly. If not, and the "goods" they have on him are still scary enough, he will rule that the bill actually originated in the House and will give it a new name and number to confirm. I´m not going to hold my breath on this on either. In this day and age, I simply don´t trust the SCOTUS to do the Constitutional thing on anything. As previously stated, it´s all about ideology. And far left ideology at that.

And poster #15, that is a point that I have been advocating for quite some time now. I just don´t see the people of this country taking back what was and what was intended in any manner short of another rebellion. There are just too many on the federal dole and too many that are clinging onto there perceived power. Voting isn´t going to get rid of any of that

Although I sometimes diaagree with George Will, there´s no denying the facts, reasoning, and cogency on display in this column, which could stand by itself as a successful brief to the D.C. Circuit Court of Appeals (or to the SCOTUS). If the ACA is not struck down on the constitutional grounds of origination, the justices voting to affirm it should be impeached for flouting their oaths of office. The illegality of what Reid did is prima facie. It really is that simple.

This article gives the scenario to prove that John Boehner was derelict in his duties as Speaker of the House to immediately initiate a lawsuit against the originality clause concerning this bill.

Roberts decision was most likely one where he gave the House this power play, but he was one who did not wish to through the bill out with the bathwater and the Supremes had already been chastised about the 2000 election and didn´t want a repeat of that situation.

At the time Roberts said, "It´s a tax," I realized that was like the infamous "ACME" ticking time bomb the Wiley Coyote Dems were holding while standing in the tar trap on the road.

Especially damning, and hopefully being used by the Plaintif attorneys, are the falsified GAO records showing it as being "budget neutral". In order for a Senate bill to go to the House under the un-Constitutional trick called, "Budget Reconciliation" it must not affect the budget negatively, meaning it does not increase taxes. Clearly, Obamadontcare has raised taxes for all American "producers."

Maybe it is time for a shake-up. President Obama’s second-term staffing was always going to be a risk. He abandoned his first term’s team of rivals for a closer-knit team of loyalists.
